NOTICE OF PUBLIC HEARINGS
Pursuant to M.G.L. c. 7, § 3B, c. 112, §85, and c. 30A, the Executive Office of Administration and Finance (A&F) and the Board of Registration in Embalming and Funeral Directing ("Board") will hold two public hearings relative to proposed amendments to regulations located at 239 CMR 3.00 and 801 CMR 4.02. The proposed changes are intended to simplify license requirements for funeral directors, create a new license for assistants, as well as numerous changes designed to enhance readability and clear up ambiguities. Standards of practice are being updated to reflect common problems in the funeral profession, and advertising and establishment certificate regulations are being updated to be more business friendly. Establishment insurance requirements are being updated to create uniform rules rather than a current system requiring insurance only with the use of certain types of business entities. Finally, fees are being updated to accommodate the changes in license types. These regulations apply to approximately 651 funeral homes in Massachusetts, most of which are small family owned businesses. Minimal to no administrative costs anticipated by these regulation changes. The goal of these amendments is to adopt reasonable license requirements and standards of conduct in the most business friendly way possible, therefore, the regulations provide minimum standards necessary for the protection of the public's health, safety, and welfare and make no attempt to codify the best business practices in the funeral industry. These amendments do not duplicate or conflict with any other state agency. Further, the regulations are being changed to encourage the formation of new businesses.
The hearings will be held
- at 10:00 a.m. on Tuesday, May 24 th, 2011 at 1000 Washington Street, 1 st Floor, in Boston and
- at 1:00 P.M. on Thursday, May 26 th, 2011 in room B-42, 436 Dwight Street in Springfield.
Interested Parties will be given an opportunity to present testimony orally or in writing at these hearings.
