DUTY TO PROVIDE RECORDS TO PATIENT OR REPRESENTATIVE
(M.G.L.. c. 112, s. 12CC)
Since many complaints received by the board related to patient requests for copies of records, the board advises all licensees to review Mass. Gen. Laws Chapter 112, section 12CC. This statue provides, in part, that "a health care provider who maintains records for a patient treated or examined by such provider shall permit inspection of such records by such patient or an authorized representative of the patient, and upon request and payment of a reasonable fee shall make a copy of such patient records available such patient or such representative."
Section 12CC also authorizes a psychotherapist to exercise "professional judgment " in determining whether providing the entire record to the patient would adversely affect the patient's well-being. The statue further provides that if a decision is made NOT to release the entire file to the patient, then the entire record must be made available to the patient's attorney or such other psychotherapist designated by the patient.
