BOARD POLICY
ASME – NOTIFICATION OF ENFORCEMENT
(enacted 05-19-2010)


It has come to the attention of the State Board of Examiners of Plumbers and Gas Fitters that 248 CMR 2.14(10)(b) is not being enforced as stated.

A meeting was held with various Representatives of the Manufacturers of Water Heaters and Storage Tanks at the office of the State Board of Examiners of plumbers and Gas Fitters at 239 Causeway St, Boston. At this time, the Subcommittee notified the attendees that the Board will not allow this practice on non-compliance to continue and have made the following rulings and clarifications with regards to Section 2.14(10)(b).

Exceptions:

Private Residence: shall mean a single family dwelling only or a single Condominium unit having separate water heating source for the specific needs of that unit only.

Standing Policy:

Any tank over 120 gallons and/or a recovery rate equal to 200,000 BTU installed within the Commonwealth of Massachusetts other than as stated under Exceptions shall meet A.S.M.E. Standards. A tank shall have the A.S.M.E. certification data for each tank displayed as required in 2.14(10)(b). All safety controls required by A.S.M.E. shall be supplied in strict compliance with said standards.

Example #1: An 80-gallon tank with a recovery rate of 210,000 BTU must comply with A.S.M.E. Standards.

Example #2: Two tanks installed each with 100 gallon capacity with an indirect water heater with a recovery rate of 210,000 BTU feeding tanks shall meet A.S.M.E. standards.

Warranty Exchange: Any replacement tank provided under any manufacturer’s Warrantee Exchange program, following the grace period allowed by this Board, shall be in full compliance with 248 CMR section 2.14(10)(b).

The State Board of Examiners of Plumbers and Gas Fitters has voted to allow a three month grace period. Starting on April 2, 2003, and ending July 1, 2003. After which time all parties must be in strict compliance with 248 CMR section 2.14 in its entirety.

An alternate to an ASME Tank as adopted by the Massachusetts State Board of Examiners of Plumbers and Gas Fitters in 2007.

  1. The Tank conforms with the following UL-174 testing
  1. Section 33: Two (2) times the maximum working pressure or 300psig maximum.
  2. Section 22: One hundred fifty (150) psig and two hundred ten (210) degree maximum.
  1. The Tank will have a minimum of a ten (10) year Guarantee.
  2. A maximum of a four (4) tanks may be installed in a tandem situation.
