• January 29, 2014 Board Meeting Minutes

DISCUSSION:

D1) Bob Torbin from Omegaflex would like to discuss CSST sales in the big box stores and the current Board policy regarding protection of CSST piping outside underground. Additionally, Mr. Torbin will be showing the Board a new fitting which is being incorporated into the Omegaflex CSST system.

D2) Zoe Neale (G2E organics consultant will speak to the Board regarding a new product which grinds food waste but does not empty into the sanitary drainage system. In addition to Mr. Neale the following will also be at this meeting: Jamie Wojcik: G2E regional sales, Jim Strain: Whole Foods Construction Coordinator, Karen Franczyk: Whole Foods Eco Czar. Jim Strain and KarenFranczyk are in attendance, as Whole Foods would like to install a Grind2Energy system in their Andover store to facilitate organic waste diversion.

D3) Response letter from Watts to Board members regarding alleged failure of brass PEX fittings

VARIANCE REQUESTS:

PV133) NORTHEAST BIODIESEL, LLC – 79 SILVIO DRIVE – GREENFIELD

The Petitioner (Lynn Benander, CEO) requests a variance from 248 CMR 10.10 (18) Table 1. The petitioner proposes the installation of one unisex restroom in the new industrial plant being built in the Industrial Park.  The plant is not open to the public and will only have 2 – 5 people in the plant at one time. The Board office is in receipt of the petition letter sent to the Greenfield Board of Health.

PV141) TAUNTON HIGH SCHOOL – ALEXIO STADIUM – 50 WILLIAMS STREET – TAUNTON

The Petitioner (Eugene Kingman) requests a variance from 248 CMR 10.10 (18) Table 1, to reduce the number of plumbing fixtures required by 50%. The Taunton Board of Health has no objection to the request as stated in the application.

PV148) VALENTINO USA – 47 NEWBURY STREET – BOSTON

The Petitioner (Carmine Pappagallo) requests a variance from 248 CMR 10.10 (18) (i) Table 1. The existing two employee restrooms were moved and converted to one unisex handicapped accessible restroom. Petitioner is seeking relief from the requirement to install two restrooms. In accordance with MGL c.142 s. 13, the petitioner provided the Board office with a copy of a letter sent to Boston Inspectional Services

PV149) MONOMOY REGIONAL HIGH SCHOOL – 75 OAK STREET – HARWICH

The Petitioner (Jorge Figueirido) requests a variance from 248 CMR 10.10 (18) Table 1, to reduce the number of fixtures for stadium seating at the Monomoy high school. The Harwich Board of Health voted on January 7, 2014 to supports the request as follows:

Female restroom - 4 Water Closets & 2 Lavatories.

Male restroom 2 Water Closets – 2 Urinals and 2 Lavatories.

1 unisex restroom.

Contingency plan in place for capacity crowds to allow access to school buildings and/or portable facilities placed on site.

PV150b) DENTAL OFFICE – 29 HARVARD STREET, 3RD FLOOR – BROOKLINE

The Petitioner (Sara Lavado, P.E.) requests a variance from 248 CMR 10.10 (18) Table 1. Petitioner seeks relief from the requirement to provide men’s and women’s restrooms for patients and visitors. In lieu, the petitioner proposes the installation of a unisex handicapped accessible restroom.

PV152) CUMBERLAND FARMS – 594 UNION STREET - NORTHADAMS

The Petitioner (Kathleen Sousa) requests a variance from 248 CMR 10.10 (18) (i). Petitioner proposes the installation of one unisex handicap accessible restroom for use by employees and patrons. The granting of this variance would offer the opportunity to more effectively utilize area for the merchandising of project that otherwise be dedicated to a second restroom. The petitioner provided the Board office with a copy of sent to the North Adams Board of Health. Included in the application submittal was a letter from the North Adams Plumbing Inspector, Norman Rolnick, who supports the variance request.

PV155) PROPOSED RESTAURANT – 96 WASHINGTON STREET – GLOUCESTER

The Petitioner (Carlo Barbara) is proposing a restaurant that would have seating for 32 people. There could be four full time employees and eight part time employees. The small space is 1400 square feet. The space presently has a large unisex handicapped rest room. Mr. Barbara is seeking relief to not be required to install a second restroom. The Gloucester Board of Health supports this variance request.

PV156) FINE ARTS THEATRE PLACE LLC – 19 SUMMER STREET - MAYNARD

The Petitioner (Ms. Melanie Perry, Co-Owner) requests a variance from 248 CMR 10.10 (18) Table 1. The Plumbing Inspector, The plumbing inspector Mr. Adam Sahlberg advised the owner that the plumbing in the building needed to be brought up to code. Ms. Perry contacted the Building Official regarding the building plumbing and he advised her it did not comply with the Building Code, including the number the number of bathroom fixtures. The petitioner provided the Board office with the petition letter sent to the Maynard Board of Health.

GV157) MIDDLESEX COMMUNITY COLLEGE – 44 MIDDLE STREET - LOWELL

The Petitioner (Jeffrey White) requests a variance from NFPA 54 to fire a rooftop heating unit at 4” WC instead of 6.5” WC. The manufacturer has stated in writing that the unit will fire and operate at 4” and the input will be reduced to 78%.

PV158) ASPI ENGINEER – 28 PRESCOTT WAY - WOBURN

The Petitioner (Aspi Engineer) requests a variance from 248 CMR to allow the installation of a four toilets on a 3” drain. The Woburn Board of Health takes no position in this matter.
