VARIANCE REQUESTS:

VR#32) CONAGRA FOODS INC. – 153 INDUSTRIAL BOULEVARD – TURNERS FALLS

The Petitioner (Patrick Randall, Project Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Fuel Gas Code, Section 3.04 (1). The petition proposes the installation of three gas fired ovens that are not product accepted. UL conducted a field evaluation of the ovens. By delegated authority the Board Office, along with Chairman Kennedy reviewed and approved the report. As this is a Gas Variance, no Board of Health letter is required.

VR#119) ORLEANS DERMATOLOGY & LASER TREATMENT – 3 NAMSKAKET RD – ORLEANS

The Petitioner (Dr. Miriam Kravitz, Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (k) (5).  The petitioner seeks relief to use bottled water coolers in lieu of drinking fountains.  Petitioner has agreed to install rough plumbing.  The Orleans Board of Health voted to support this petition.

VR#122) MEDICAL OFFICE BUILDING – 91 NEWBURY STREET – BOSTON

The Petitioner (Doug Anderson) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner proposes to install one unisex handicapped accessible restroom for staff and one for patients and visitors. The petitioner provided this office with a copy of the petition letter sent to the Boston Board of Health.

VR#128) FAMILY LAUNDROMAT – 95 CONGRESS ST – SALEM

The Petitioner (Mr. Walther Bene, Associate) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) to allow one bathroom.  The petitioner provided this office with a copy of the petition letter sent to the Salem Board of Health.

VR#129) JUNIPER GARDENS – 18 JUNIPER STREET – BROOKLINE

The Petitioner (Mr. Gregg Connelly, Journeyman Plumber) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.14 to approve (post-installation) a domestic water heater that has not been Board accepted.  The Brookline Board of Health has no objection to this applicant’s request.

VR #130) WATERSIDE PLACE APTS – 505 CONGRESS ST – SOUTH BOSTON

The Petitioner (Mr. Joseph Mierzejewski, Project Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.07 to install non-board-accepted 24” concrete piping to 15” service weight cast iron.  As this is a State project, no Board of Health letter is required.

VR #131) UMASS – 100 MORRISSEY BLVD – BOSTON

The Petitioner (Mr. Joseph Morgan, Associate, Wilson Architects) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1 Petitioner seeks to install 17 drinking fountains instead of the required 31.  As this is a State project, no Board of Health letter is required.

VR#132) OLD TOWN HOUSE – 1 MARKET SQUARE - MARBLEHEAD

The Petitioner (Mr. Don Millis, Project Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner notes if the Town holds a lecture event the occupancy would exceed 100 persons to a maximum occupant load of 175. Relief is sought from the fixture requirements for such events. The petitioner provided the Board Office with a copy of the petition letter sent to the Marblehead Board of Health. The plumbing inspector, Domingos Futrado supports this variance request.
