VARIANCE REQUESTS:

VR-1) MELPET FARM – 93 AIRLINE ROAD – SOUTH DENNIS

The Petitioner, Mr. Tom Sisson, Facilities manager for the South Dennis DPW requests a variance from 248 CMR, Section 10.10, (i), 3 to allow the installation of one (1) unisex handicap rest room in lieu of the required two (2).

VR- 2) CHARLESVIEW DEVELOPMENT AT BRIGHTON MILLS - BRIGHTON

The Petitioner, Mr. Frederick Thomas, Senior Project Manager requests a variance from 248 CMR, Section 10.05 (2) to reduce the pitch of horizontal drain piping from 1/8” per foot to 3/32” per foot. Boston Inspectional Services is aware of this applicant’s request.

VR-3) MAJILITE CORPORATION – 1530 BROADWAY ROAD - DRACUT

The Petitioner (Mike Willwerth from Majilite Corp requests a variance from 248 CMR, Section 3.04 to allow the installation of an unlisted gas product. As this is a Gas Variance, no Board of Health letter is required.

VR-4) OCEAN SPRAY CRANBERRY INC. – 153 BRIDGE STREET - MIDDLEBORO

The Petitioner, Joseph Woytowicz, Mechanical Engineer from the Dennis Group requests a variance from 248 CMR, Section 10.06 (2) to allow the use of PE100 Polyethylene pipe and fittings on their above and below ground storm drainage system. Both the Middleboro Board of Health and the Plumbing Inspector are in favor of this variance request.

VR-5) PULCINELLA MOZZARELLA BAR & RESTAURANT – 78-80 SALEM ST. - BOSTON

The Petitioner, Craig Buttner, Archtect for the owner requests a variance from 248 CMR, Section 10.10 (18) (b) to allow the installation of one (1) unisex handicap rest room in lieu of the required two (2). Boston Inspectional Services is aware of this applicant’s request.

VR-6) NEW COMMERCIAL BUILDING – 111 FORGE ROAD - WESTPORT

The Petitioner, Americo Padinha, Owner requests a variance from 248 CMR, Section 10.09 not to require the installation of floor drains and a gas/oil separator.  The Westport Board of Health supports this variance request.

VR-7) QUEEN ANNE REALTY TRUST – 289 QUEEN ANN ROAD - HARWICH

The Petitioner, Gilbert Souza, Manager requests a variance from 248 CMR, Section 10.09 not to require the installation of floor drains and a gas/oil separator.  The Harwich Board of Health supports this variance request.

VR-8A) FRESENIUS MEDICAL CARE – 100 ROSEBROOK WAY - WAREHAM

The Petitioner, Mr. Richard Hamlin, Trustee requests a variance from 248 CMR, Section 10.10, (18) not to require the installation of drinking fountains. The Wareham Board of Health supports this variance request.

VR-8B) FRESENIUS MEDICAL CARE – 100 ROSEBROOK WAY - WAREHAM

The Petitioner, Mr. Daniel Moody from WB Engineers requests a variance from 248 CMR, Section 10.10, (18) to allow the utilization of unisex toilets for patients and public use. The Wareham Board of Health supports this variance request.

VR-9) ICE CREAM PROCESSING FACILITY – 261 LOCUST STREET - SWANSEA

The Petitioner, Kenneth Baker, Owner requests a variance from 248 CMR, Section 10.09, not to require the installation of a grease interceptor. Additionally, the petitioner requests a variance from 10.06 to allow the installation of PVC drain and vent piping in lieu of the required cast iron and copper.  The Swansea Board of Health supports this variance request.

DISCUSSION:

D1) TOPIC –  COMBINATION SPACE HEATING/POTABLE WATER SYSTEMS

Representatives from A.O. Smith Water Heaters will provide the Board with data and information that will show the current pump timer requirement of 60 seconds every 6 hours is more than adequate to mix the water in the heating coil and piping to address any concerns regarding the formation of Legionella bacterium.
