DISCUSSION:

D1) Ed Forsberg, President of the New England Plumbing Gas Mechanical Inspector Association would like to address the Board regarding Inspector Continuing Education and the current credit structure.

D2) Scott Padden will discuss material for vacuum piping at ice chests.

PV181) TREE HOUSE BREWING – 160 EAST HILL ROAD - MONSON

The Petitioner (Mr. Dean Rohan, Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The Petitioner seeks relief from the requirement to provide toilet facilities in a temporary building. Mr. Rohan notes there will be only two brewers in this build while construction on a new building which will meet code requirements. The petitioner provided a copy of the letter sent to the Monson Board of Health.

PV182) DEBORAH FREIZE RESIDENCE – 14 CHESTNUT PLACE – JAMAICA PLAIN

The Petitioner (Mr. Rick Ames, Architect) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (f). The Petitioner is seeking to install an alternative technology toilet system at this location. The petitioner provided a copy of the petition letter sent to Boston Inspectional Services.

PV184) NICHOLAS FUSARO – STORAGE BUILDINGS - 15 RIDGE HILL ROAD – ASSONET

The Petitioner (Mr. Nicholas Fusaro, Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09 (1) (b). The Petitioner states the buildings are classified as storage only and no vehicles are allowed inside or, repaired. The Freetown Board of Health does not have any reservations about the application.

PV187) – MA-PORT – TERMINAL B DEPARTURE – EAST BOSTON

The Petitioner (Ms. Robert, McNulty) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18). As this is a State project, no Board of Health letter is required. WITHDRAWN 03-12-14

PV188b) HEALTH CARE RESOURCES – 9 FORBES ROAD - WOBURN

The Petitioner (Mr. Gerard McSweeney, Chief Operating Officer) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The Petitioner states that toilet provisions (per occupancy use) are met via individual toilet rooms – 2 men & 2 women, therefore urinals are not required. The Woburn Board of Health takes no position on this matter.

PV189) LOVEJOY WHARF – 160 NORTH WASHINGTON STREET - BOSTON

The Petitioner (Mr. Chris Meurer, Project Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3:00, the Uniform State Plumbing Code, Section 3.04 (1). The Petitioner is requesting to use custom concrete lavatories for the public restrooms. The petitioner notes there will be two at each floor for a total of twenty on the project.  The petitioner provided a copy of the letter from Gary Mochia, of Boston Inspectional Services.

PV191) O’REILLY AUTO PARTS – 15 INDEDPENDENCE DRIVE - DEVENS

The Petitioner (Mr. Wayne Benson, (Principal) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner states the provisions (per occupancy) are met via four (4) individual toilet rooms and urinals are not required. The Plumbing Inspector (Robert Krupski) in an email received on March 11th indicated he is in favor of granting this request. The Woburn Board of Health takes no position on this matter.

PV194) CHILDREN’S CENTER – 628 SALEM STREET - LYNNFIELD

The Petitioner (Ms. Christina Morris, Owner/Director) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The Petitioner is requesting a variance to eliminate the need for a separate male staff restroom. Petitioner notes the center will be licensed for 34 children and 6 employees. Ms. Morris provided the Board office with an email sent to the Lynnfield Board of Health.

PV195) COMMUNITY C ENTER – 468 MAIN RD - TOWN OF MONTEREY

The Petitioner (Mr. Steve McAllister, R.A.) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The Petitioner requests relief from the requirement for a separate toilet room for each gender, and propose a single unisex handicapped accessible restroom. The Monterey Board of Health concurs with the applicant’s request and endorses the granting of a variance.

PV196) HIGH SCHOOL ATHLETIC COMPLEX RENOVATION – 275 ESSEX STREET - LYNNFIELD

The Petitioner (Mr. John M. Perry, P.E.) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The Petitioner seeks a variance to reduce the fixture requirements for this renovation project. Mr. Perry provided the Board office with a copy of the petition letter sent to the Lynnfield Board of Health.

PV197) EASTERN ICE – 281 COMMERCE DRIVE – FALL RIVER

The Petitioner (Mr. Cory Killhanm, Project Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The Petitioner notes the new addition is a dedicated refrigerated space. The petitioner seeks relief from the travel distance to employee facilities. The closest employee restroom is approximately 330 feet from the new addition. The Fall River Board of Health defers to the Plumbing Board.

PV198) DUNKIN DONUTS – 1600 NORTH HAMPTON STREET - HOLYOKE

The Petitioner (Mr. Edward Ribeiro, President) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (8) (d). The Petitioner seeks relief from the requirement from installing a commercial food waste grinder. The petitioner provided the Board office with a copy of a petition letter sent to the Holyoke Board of Health.

PV203) BOSTON PUBLIC MARKET – 136 BLACKSTONE STREET – BOSTON

The Petitioner (Mr. Seth Johnson P.E.) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner notes that there is a retail portion (market and bakery and a seafood restaurant. Total required by Table 1 is 22 for females and 21 for males. Mr. Johnson is proposing 11 female water closet and 11 male water closets for an approximate 50% reduction. As this is a state project, no Board of Health letter is required.

GV205) KIYADH AL MESHREFAW – 591 PARK AVENUE – WORCESTER

The Petitioner (Mr. Meshrefaw – restaurant owner) requests a variance from 248 CMR 3.04 to allow the installation of an Autogyros Model 4LG 30,000BTU broiler. The applicant provided the Board with the proper documentation showing this appliance has been tested to the proper standards. The manufacturer refused to apply to the Board for Product Acceptance. As this is a gas variance, no Board of Health letter is required.
