PV243a) “A” AUTO SALES – 644 STATE ROAD – WESTPORT - Prior approval on 10/6/10

The Petitioner (Ms. Daniela Fita, Business Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09(1)(b) to not require the installation of floor drains or a gas/oil/sand separator. The Westport Board of health notes in a letter from Jays Auto Service of Somerset MA., Jay’s auto service will perform all repairs for Daniela Fita. The letter is on file as proof of offsite repair.

PV243b) AUTO VICTORIA – 644 STATE ROAD – WESTPORT - Prior approval on 10/6/10

The Petitioner requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09(1)(b) to not require the installation of an employee restroom in the facility. The applicant shares a home with her fiancé is approximately 125 away from her business. The Westport Board of Health supports the request.

PV244) KETTLE CUISINE LLC – 300 LYNNWAY BUILDING, BUILDING “C” - LYNN

The Petitioner (Mr. Trent Shute, CFO) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.06(2)(g & h) to allow the installation of polypropylene for the waste and vent system. Petitioner notes the properties of polypropylene are such that the material will not corrode, as a result of the production process. Correspondence from the Plumbing Inspector, James Richards, supports the granting of this variance. The City of Lynn’s Health Division takes no exception to the use of polypropylene.

PV245) KAREN WIHITTMIER RESIDENCE – 230 GRANT STREET - LEOMINSTER

The Petitioner (Ms. Whittmier) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 3.04 (1) to allow the installation of a non-product accepted sauna/steam shower. The fixture has an ETL/Intertek listed Mark. The Leominster Board of Health has no objections to the use of the product. The Board of Health notes it has no expertise to determine if the ETL certification will be equivalent to the applicable and relevant State & Federal regulations.

PV246) PARK LANE SEAPORT APARTMENTS – ONE PARK LANE - BOSTON

The Petitioner (Mr. John Del Tufo) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10(18)(i)4. Petitioner seeks relief from the requirement to provide separate toilet facilities in business or commercial establishments exceeding 1200 square feet. As this is State property no Board of Health letter is required.

PV247 ) MWRA - QUABBIN DISINFECTION FACILITY – 735 BELCHERTOWN ROAD – WARE

The Petitioner (Mr. Jae Kim, Chief Engineer) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10(18) Table-1. The petitioner states the facility cannot accommodate either separate sex showers or a unisex handicap accessible shower without increasing the building footprint. As this is a state project no Board of Health letter is required.

PV249) CAFÉ BARADA – 2269 MASSACHUSETTS AVENUE – CAMBRIDGE

The Petitioner (Mr. Frank Barrows, Master Plumber) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10(18) Table-1. Petitioner seeks a variance to allow this restaurant, which has less than 1,000 square feet to have one unisex handicap restroom and one unisex non-handicap restroom. The Board office received a copy of the petition letter sent to the Cambridge Inspectional Services Department.

GV250) BEACON STREET LLC – 12 BEACON STREET - STONEHAM

The Petitioner (Mr. Lawrence Russo) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Fuel Gas Code, Section 3.04(1) to allow the installation of a fully-restored gas range.. As this is a gas variance no Board of Health letter is required.

PV252) JESSICA MUTASCIO - CHILD DAY CARE – 522 WEST CENTRAL STREET - BROCKTON

The Petitioner (Ms. Jessica Mutascio, owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.04(6)(a) and 10.07. Petitioner seeks a waiver to allow the use of PVC for the renovation project. This office is in receipt of the petition letter sent to the Brockton Board of Health.

PV257) DCR – J. C. COMPANY / CONCESSIONAIRE – JOHN REED ROAD - WESTPORT

The Petitioner (Mr. Raul Silva, Deputy Chief Engineer) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10(18) Table 1. Petitioner is seeking a waiver from the requirement to install staff toilets inside the concession trailer. As this is a state project, no Board of Health letter is required.
