VARIANCE REQUESTS:

PV133a) DEVEREUX FOUNDATION – 60 MILES ROAD - RUTLAND

The Petitioner (Mr. Arni Casareale) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner seeks relief from the requirement to install separate male and female restrooms. The proposed renovation consists of 670 sq. ft. of the 1360 sq. ft. single story building. The petitioner proposes the installation of one unisex restroom. The Rutland Board of Health has no objections for a change of installation of plumbing at Devereux.

The petitioner seeks relief from the requirement to install a service sink. The Rutland Board of Health has no objections for a change of installation of plumbing at Devereux.

The petitioner seeks relief from the requirement to install a drinking fountain. The petitioner proposes the installation of a water cooler. The Rutland Board of Health has no objections for a change of installation of plumbing at Devereux.

PV195) WEST STREET TAVERN & RESTAURANT – 7 WEST STREET – NEWTON

The Petitioner (Mr. Karl Roche) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. In 2011 the City of Newton granted the petitioner a permit for an additional 15 outdoor seats. It was determined during a routine inspection by the City, that the number of handicap restrooms was inadequate for the current seating of 54 and the additional 15 outdoor seats. The Newton Board of Health supports the granting of this variance with the single existing unisex restroom.

PV248) RESIDENCES AT ROSE LANDING – 360 ANDOVER STREET – DANVERS

The Petitioner (Mr. Patrick Sharkey) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09 (1) (b). Because the site elevations and distance from the street do not allow for gravity drainage, the petitioner seeks relief from the requirement to install floor drains and a gas/oil/sand separator. The petitioner provided the Board office with a copy of the petition letter sent to the Danvers Board of Health.

PV256) COFFEE TIME – 44 W. WYOMING AVENUE - MELROSE

The Petitioner (Mr. Cristos Rapptelus, owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner seeks relief from the requirement to install male and female handicap accessible restrooms. The petitioner proposes the installation of one handicap restroom and one non-handicap restroom. The petitioner provided the Board office with a copy of the petition letter sent to the Melrose Board of Health.

PV259) MOFROYO FROZEN YOGURT – 512 WESTFIELD ROAD - HOLYOKE

The Petitioner (Mr. Todd Cieplinski, Proprietor) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The area of this space is  1,946 sq. ft. The petitioner seeks relief from the requirement to install two unisex handicap accessible restrooms. Petitioner is proposing the installation of one unisex handicap accessible restroom. The petitioner provided the Board office with a copy of the petition letter sent to the Holyoke Board of Health and the response letter from the Board of Health indicating no objections and support for the granting of this request.

PV262) H. T. BERRY CO., INC. – 50 NORTH STREET - CANTON

The Petitioner (Mr. Ralph Perelis, Project Executive) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (i) 2. The area of the new addition is a warehouse designed for racking and dry storage only. Employees utilize motorized pallet/forklift trucks only. The petitioner seeks relief from the 300 foot travel distance limit. Travel distance to a restroom is 449 feet. The Canton Board of Health supports the petitioner’s waiver request.

PV264) Rt2 HYUNDAI – 743 MAIN ROAD - LEOMINSTER

The Petitioner (Mr. Dilvo, DiPlacido, owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (i). The proposed inspection bay is 150 ft. from the dealership building. The petitioner notes the travel distance to existing restrooms is 350 feet. The petitioner is proposing to install one unisex employee restroom if the new inspection bay. The petitioner provided the Board office with a copy of the petition letter sent to the Leominster Board of Health

PV265) HIGHER GROUND BAPTIST CHURCH – 85 BASS AVENUE-UNIT 7 - GLOUCESTER

The Petitioner (Mr. George T. Jackman, Senior Pastor) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (c). The area of the unit is 785 square feet with a projected occupancy of 25 persons. There is an existing unisex handicap accessible restroom. The petitioner seeks relief from the requirement to install a second restroom. The Gloucester Board of Health has no objection with this request.

GV266) KEN FULK RESIDENCE – 471 COMMERCIAL STREET - PROVINCETOWN

The Petitioner (Mr. David  E. Erickson) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Plumbing Code, Section 3.04 (1). Mr. Erickson restored a Circa 1925 Glenwood range. Mr. Erickson had the gas valves thermostat rebuilt and calibrated. The gas valves & thermostat were, rebuilt and calibrated. The oven was updated with a Robert Shaw “TS” series, 100% safety pilot shutoff with pilot and thermocouple. The stove will utilize propane as the fuel source. As this is a gas variance, no Board of Health letter is required.

PV268) UMASS LOWELL – LEITCH RESIDENCE HALL – 111 PAWTUCKET AVENUE

The Petitioner (Ms. Nancy Gould, Engineer) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) 2.a. Due to the limited space limitations, the applicant seeks relief from the requirement to provide one (1) washing machine connection for every 32 students residing in the building. As this is a state project, no Board of Health letter is required.

The Petitioner (Ms. Nancy Gould, Engineer) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) 2.a. Due to the limited space limitations, the applicant seeks relief from the requirement to provide one (1) washing machine connection for every 32 students residing in the building.
