VARIANCE REQUESTS:

PV284) MARKET SQUARE BAKE HOUSE - 5 MARKET SQUARE - AMESBURY

The Petitioner (Ms. Tanya, Tzitzon) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (2) c. The Petitioner notes the space is 1,527 sq. ft, with seating for 17 patrons and with 2 employees. Petitioner proposes the installation of one unisex handicapped accessible restroom in lieu of the required two. The applicant provided the Board office with a copy of the petition letter sent to the Amesbury Board of Health

PV289) SOUTH COVE MANOR NURSING & REHAB- 288 WASHINGTON STREET - QUINCY

The Petitioner (Mr. R. Phillip Dowds, AIA) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The Petitioner requests that the requirement for gender segregated toilets be waived for eight common toilets dedicated to resident use plus a pair in the lobby. The petitioner notes that signage and use of these ten rooms as gender neutral (unisex). The applicant provided the Board office with a copy of a letter sent to the Quincy Board of Health.

PV301) BLUE LOTUS HEALING ARTS – 945 GREAT PLAIN AVENUE - NEEDHAM

The Petitioner (Mr. Kevin Smith, Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The Petitioner seeks relief from the requirement to provide toilet facilities within the spaced. Petitioner notes there are common designated facilities with 10’ of the main entry door. Each restroom has 3 toilets and two sinks. These facilities serve three other offices on the same floor with a total occupancy of six. The occupant load for Blue Lotus is fifteen (15). The applicant provided the Board office with the email letter sent to the Needham Board of Health.

PV302) HOUSING AUTHORITY – 116 CHURCH STREET - GARDNER

The Petitioner (Mr. David Curran, Executive Director) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.17 Table 2. The Petitioner notes Table 2 allows a 3” drain to serve 2,200 sq. ft of roof area, or 4,400 for the two drains, therefore, the size of the vertical conductors are insufficient. An additional 2: diameter drain would be required to meet current code.  Mr. Curran is not in possession of a copy of the 1992 version of the plumbing code but, requests the Board consider that a building of this scale could not have been constructed without proper permitting, inspections and approval for occupancy. The Board office received an email from Nault Architects to the Gardner Board of Health and confirmed by Bernard Sullivan indicating no objections.

PV303) PUBLIC SCHOOLS (PROPOSED) – 60 PROSPECT STREET - GLOUCESTER

The Petitioner (Mr. Kevin Buckley, Project Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The Petitioner notes the City of Gloucester has arranged to the temporary use of this 130 year old building for two years. The petitioner notes presently the building exceeds the number of toilet fixtures required for the proposed number of students per the Table. The petitioner is requesting relief for staff facilities. The Gloucester Board of Health has no objection with this request.

PV309) WAVERLY OAKS ATHLETIC CLUB – 411 WAVERLY OAKS ROAD - WALTHAM

The Petitioner (Mr. Chris Deignan, Facilities Director) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The Petitioner notes the facility is on three floors. There is an elevator connecting all three floors. The ground floor contains the majority of plumbing fixtures. Relief is requested for exceeding the occupant load on the mezzanine level by six and the occupant load at the first floor level by 43 occupants. . The Board office is in receipt of the petition letter from the Waltham Board of Health.
