VARIANCE REQUESTS:

VR1) MA-PORT – EDGE SPORTS ARENA – 191 HARTWELL ROAD - BEDFORD

The Petitioner (Mr. Steve Quieto, P.E.) appears before the Board to discuss the issues with this project.

VR2) ONYX SPECIALTY PAPERS – 40 WILLOW STREET

The Petitioner (Mr. Thomas Beebe, Project Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Fuel Gas Code, Section 3.04 (1). The variance is required for a temporary rental boiler not product accepted. A factory representative performed the startup and witnessed by the Engineer. This office received the Engineer’s final report. The Board Office and Chairman Kennedy reviewed the reports and found them acceptable. As this is a gas variance, no Board of Health letter is required.

VR3) PELICAN INDUSTRIES – 147 NORTH MAIN STREET – SOUTH DEERFIELD

The Petitioner (John Sobierski, P.E.) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Fuel Gas Code, Section 3.04 (1). The variance is required for rotating molding machines not product accepted. A factory representative performed the startups and witnessed by the Engineer. This office received the Engineer’s final reports. The Board Office and Chairman Kennedy reviewed the reports and found them acceptable. As this is a gas variance, no Board of Health letter is required.

VR4) ROSELAND PROPERTIES – 1 OVERLOOK RIDGE DRIVE - REVERE

The Petitioner (Thomas Mann, Master Plumber) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.12 (1) (i) 2 (Safe Waste Pans). The Revere Board of Health letter defers to the Board.

VR5) SCHLICHTE & JOHNSTONE LAW OFFICE – 14 PLEASANT STREET - GLOUCESTER

The Petitioner (Ms. Patricia Johnstone, Attorney) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. Petitioner seeks a waiver to install one unisex handicap accessible employee restroom. The Gloucester Board of Health defers to the Board.

VR 6) MEDICAL HEALTH CARE -BODY SCULPT . – 100 SYLVAN ROAD - WOBURN

The Petitioner (Mr. Michael Aveni, Architect) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner seeks a waiver from the shower requirement. The Board delegated authority to the Board Office to waive the shower requirement in medical and health care facilities. Mr. Aveni provided a copy of the petition letter sent to the Woburn Board of Health.

VR7) TRACTOR SUPPLY – 3017 CRANBERRY HIGHWAY - WAREHAM

The Petitioner (Glen Oxford, Architect) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09 (1) (b). The petitioner states he will install permanent bollards to prevent the entry of vehicles. The Board delegated authority to the Board Office to grant variances when bollards are installed. Mr. Oxford provided a copy of the petition letter sent to the Wareham Board of Health.

VR8) EXTREME KUSTOMZ – 702 MONTELLO STREET - BROCKTON

The Petitioner (Peter Nasiofoulos, owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09 (1) (b). The petitioner seeks a waiver from the requirements of the herein reverenced code section. The Brockton Board of Health stands behind the petitioner’s request for a variance.

The petitioner contacted Mr. Thomas to request the variance be moved to the 10/03/2012 meeting

VR9) GOOSE COVE PUMP STATION – 593a WASHINGTON STREET - GLOUCESTER

The Petitioner (Mr. Ryan Marques, P.E.) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.06 (2) (o). The petitioner seeks a waiver from the material requirements. The Gloucester Board of Health has no objection with this variance request.

VR 10) FRESENIUS MEDICAL CENTER – 110 MOUNT WAYTE AVENUE - FRAMINGHAM

The Petitioner (Mr. Michael Racette, Project Engineer) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner proposes installing one employee unisex handicap accessible restroom and one public unisex handicap accessible restroom in lieu of separate designated restrooms. The Framingham Board of Health voted unanimously to support the applicant’s request.

VR11) TIRE WAREHOUSE – 1136 MAIN STREET - CLINTON

The Petitioner (Robert Mocarsky, AIA) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09 (1) (b). Petitioner seeks a waiver from the requirements to install floor drains and a gas/oil/sand separator. Mr. McCarsky provided a copy of the petition letter sent to the Clinton Board of Health.

VR12a) EXCEL ORTHOPEDIC SPECIALTIES – 150 PRESIDENTIAL WAY - WOBURN

The Petitioner (Robert Marshall, P.E.) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner seeks a waiver from the shower and drinking fountain requirements. The petitioner proposes the installation of one bi-level water cooler adjacent to each toilet core. A bi-level water cooler is accessible to each waiting room. The Board delegated authority to the Board Office to waive the shower and drinking fountain requirements in medical and health care facilities. Mr. Marshall provided a copy of the petition letter sent to the Woburn Board of Health.

VR13a) MEDICAL OFFICE BUILDING – 501 MAHER HIGHWAY - BRAINTREE

The Petitioner (Mr. John Guinzali) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner seeks a waiver from the shower requirement. The Board delegated authority to the Board Office to waive the shower requirement in medical and health care facilities. Mr. Guinzali provided a copy of the petition letter sent to the Braintree Board of Health.

VR13b) MEDICAL OFFICE BUILDING – 501 MAHER HIGHWAY - BRAINTREE

The Petitioner (Mr. John Guinzali) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.15 (10). The petitioner seeks a waiver to allow one of fourteen sinks to drain to an ejector pump system. Mr. Guinzali provided a copy of the petition letter sent to the Braintree Board of Health

VR14) NORTHEAST CABINET – 480 NEPONSET STREET – CANTON

The Petitioner (Mr. George Ford) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09 (1) (b). The petitioner proposes installing permanent bollards to prevent the entry of vehicles. When permanent bollards are, installed the Board delegated authority to the Board Office to grant such variances. The Braintree Board of Health has no objection with this request.

VR15) HIGH SCHOOL – ATHLETIC FACILITY – 65 EAST UNION STREET - ASHLAND

The Petitioner (Mark J. Purple, Interim Town Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. A variance was granted on March 30, 2012 regarding fixture counts. The petition seeks to amend the prior variance based on a reduced occupancy. Mr. Purple provided a copy of the petition letter sent to the Ashland Board of Health. The Ashland Board of Health voted to support the waiver.

VR16) RESIDENCE - STEVE KOZIOL – 13 RICE DRIVE - WILBRAHAM

The Petitioner (Bradley Kennison) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (7) (c) 1. Based upon a limited space, the petitioner requests a waiver from the 900 square inches for a shower base to allow for the installation of a neo-angle shower unit that is not product accepted. The square footage for the neo-angle unit is approximately 817 square inches. Mr. Kennison provided the office with a copy of the petition letter sent to the Wilbraham Board of Health. The Board of Health does not have an issue with the reduced size.

VR 17) RESIDENCE -MARCIA COLBERT – RAKU KILN – 1 CAMP STREET ONSET

The Petitioner (Mr. Wayne Griffith, P.E.) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Fuel Gas Code, Section 3.04 (1). The Kiln is not product accepted A factory representative performed the startup and witnessed by the Engineer. This office received the Engineer’s final report. The Board Office and Chairman Kennedy reviewed the report and found it acceptable. As this is a gas variance, no Board of Health petition letter is required.

VR18) TROLLEY CHEF HOT DOGS – 265 COUNTY STREET – NEW BEDFORD

The Petitioner (Miatthewl Stott, Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (i) c. 6. The petition seeks a waiver to not install any toilet facilities in this food establishment. Mr. Stott provided this office with a copy of the Board of Health petition letter sent to the New Bedford Board of Health.
