VR1) WHITE MOUNTAIN CABLE CONSTRUCTION - 632 LAKE STREET - SHREWSBURY

The Petitioner (Mr. Edward DeFeudis) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner will construct a new space metal cold storage building for a tenant. The tenant states there is no need for heat or plumbing as employees will only enter to pick up materials for their jobsite. The Shrewsbury Board of Health is not opposed to this variance request.

VR 2) FALMOUTH ICE HOCKEY - THOMAS B. LANDERS ROAD - FALMOUTH

The Petitioner (Mr. Don Dilullo, Architect) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner states the proposed ice arena is designed for seating 650 spectators. The petitioner seeks a reduction in the amount of fixtures required by Table 1. It is proposed that 4-toilets and 2-sinks in the women's restroom and 2-toilets, 2-urinals and 2-sinks in the men's restroom. The Falmouth Board of Health sees no problem with the proposed plan to reduce the number of public restroom fixtures.

VR3) HOLYOKE HIGH SCHOOL - 500 BEECH STREET - HOLYOKE

The Petitioner (Mr. Del Smith, PE) requests a variance from 248 CMR (Code of Massachusetts Regulation) 5.00, the Uniform State Fuel Gas Code, Section 5.02 (2.). The petitioner is requesting the Board allow a 2" pressure drop in lieu of the maximum 0 .5" water column pressure drop required by the code modification. As this is a gas variance, no Board of Health letter is required.

VR4) ACE METALS RECYCLING & PACKAGING - 451 AMERICAN LEGION HWY - WESTPORT

The Petitioner (Mr. Eric Abate, owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (i) 4. The petitioner is requesting the Board waive the requirement of employee facilities in the warehouse, which does not have water. The Westport Board of Health voted to approve not requiring a bathroom in the warehouse.

VR5) HOME MARKET FOODS - 140 MORGAN DRIVE - NORWOOD

The Petitioner (Mr. David Bell, Process Engineering Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Fuel Gas Code, NFPA 5.6.1.3 and 5.6.2.2. The petitioner states it is necessary to use, a sixty inch (60") braided stainless steel hose in this application, because the burner is, attached to a section of oven that is mechanically, raised and lowered 24" for cleaning purposes. As this is a gas variance, a Board of Health letter is not required.

VR6) LITTLE LEAGUE CONCESSION STAND - SWEENEY PARK - SUMMER ST. MANCHESTER

The Petitioner (Mr. Michael Coyne) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (1). The petitioner is requesting the Board waive the requirement to install an employee restroom in the concession stand. The Manchester Board of Health has no objection to the proposal.

VR7) UMD - SCIENCE & ENGINEERING BLDG.- 285 OLD WESTPORT RD. NORTH DARTMOUTH

The Petitioner (Peter Radzim, PE) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.13. The petitioner is proposing to install a 12' foot vertical section of polypropylene pipe material. As this is a State project, no Board of Health letter is required.

VR8) BRIDGEWATER STATE UNIVERSITY - 131 SUMMER STREET - BRIDGEWATER

The Petitioner (Seth Johnson, PE) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00 & 10.00, the Uniform State Plumbing Code, Section 3.04(1) & 10.06. The petitioner requests a waiver to allow the installation of stainless steel pipe and fittings in the greenhouse, which is not product accepted. As this is a State project, no Board of Health letter is required.

VR9) FIRST STUDENT TRANSPORTATION, INC. - 24 CANDLEWOOD LANE - DENNISPORT

The Petitioner (John Tadema-Weilandt) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09 (b) 4. As a result of failing to comply with the DEPs Underground Injection Control Program, the property owner is currently under an Administrative order to close the dry-well. The petitioner requests a waiver to seal the floor drain(s) and file a WS1 form with the Local Inspector. The Dennis Board of Health petitions the Board of Examiners to grant this variance.

VR10a) UMASS MEDICAL SCHOOL 55 LAKE AVENUE NORTH WORCESTER

The Petitioner (Kevin Hastings, PE) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.02 (7). The petitioner is seeking relief from the policy that requires completely independent secondary roof drains. As this is a State project, no Board of Health letter is required.

VR10b) UMASS MEDICAL SCHOOL 55 LAKE AVENUE NORTH WORCESTER

The Petitioner (Kevin Hastings, PE) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (h) 4. to allow a design with common toilet rooms shared by Staff and Students. As this is a State project, no Board of Health letter is required.

VR11) FITNESS MOM STUDIO - 240 ANAWAN STREET - REHOBOTH

The Petitioner (MS. Julia Sweet) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (i) and 10.10 (18) Table 1. The petitioner is requesting the Board waive the requirement to install the required restroom facilities. The Rehoboth Board of Health supports the rules and regulations of the State Plumbing Code.

VR12a) WEST SPRINGFIELD H.S. - MAINTENANCE BLDG - 425 PIPER ROAD - W SPRINGFIELD

The Petitioner (Mr. Ira Levine, PE) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (i). The petitioner is requesting the Board waive the code requirement to install two employee restroom facilities. The petitioner is proposing to install one unisex handicap accessible restroom. The West Springfield Board of Health has no objections. The Building Commissioner and the Plumbing Inspector do not object to the proposal to reduce the number of restrooms in this building.

The petitioner is requesting the Board waive the code requirement to install two employee restroom facilities. The petitioner is proposing to install one unisex handicap accessible restroom. The West Springfield Board of Health has no objections. The Building Commissioner and the Plumbing Inspector do not object to the proposal to reduce the number of restrooms in this building.

VR12c) WEST SPRINGFIELD H.S. - TRACK & FIELD SEATING - 425 PIPER ROAD - W SPRINGFIELD

The Petitioner (Mr. Ira Levine, PE) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner is requesting the Board waive the Table 1 fixture requirements to allow a 50% reduction for calculating the minimum number of fixtures to be, installed. The West Springfield Board of Health has no objections. The Building Commissioner and the Plumbing Inspector do not object to the proposal as long as the number of accessible fixtures in not reduced.

VR13) CERAMIC TO METAL SEALS - 33 East Street - Winchester

The Petitioner (Mr. Stephen Ingemi, President) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Fuel Gas Code, Section 3.04 (1.). Existing gas furnaces are being relocated from the Melrose facility to a new facility in Winchester. The existing furnaces were never tested to a standard. Ceramic to Metal Seals retained the testing services of Panorama Consulting & Engineering, Inc to perform a field test of the equipment at the Melrose and the Winchester site. The report confirms the equipment is installed is in compliance with 248 CMR. As this is a gas variance, no Board of Health letter is required.

EXECUTIVE DIRECTOR COMMENTS:

ED1) RITZ CARLTON - 1 AVERY STREET - BOSTON - UNIT 25B

This matter was heard on April 7, 2011 and was Tabled with a condition.

CONDITION: The Board will require correspondence from the engineering firm that designed the Sovent system. This office, on May 23, 2001 received the required documentation.

ED2) R.W. LYALL & COMPANY.

Mr. Peluso distributes a demo compact disk to each Board member. The disk was, provided by R.W. Lyall & Company, Inc., manufacturer of piping distribution products. Members are, asked to review the disk and provide commentary at the next scheduled Board meeting.

ED3) ENGINEER'S CERTIFICATION FOR SPECIAL PERMISSION GAS.

Mr. Peluso distributes a draft stand alone engineer certification document and a draft of a revised SPG application. Mr. Peluso will explain the proposed documents.
