VARIANCE REQUESTS:

VR1) PAUL REVERE MEMORIAL MUSEUM – 5-6 LATHROP PLACE - BOSTON

The Petitioner (Ms. Nina Zannieri, Executive Director) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (b) 2, The building is a four-level facility and approximately 3,700 square feet. Three floors will be accessible to the public. The petitioner is proposing one unisex handicap accessible restroom on each of the three public floors. They restrooms will be designated as “Family” toilet rooms. The upper level floor will have a unisex non-handicap restroom. Boston Inspectional Services acting as the Board of Health defers to the Board..

VR 2) FIBA TECHNOLOGIES INC – 97 TURNPIKE ROAD - WESTBORO

The Petitioner (Mr. Jezerski, Facilities Maintenance Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09 (1) Overhead Doors. The petitioner is requesting a waiver from the floor drain and gas/oil/sand separator requirements. The petitioner is proposing permanent bollards that will allow the entrance of electric forklifts. The Westborough Board of Health notes any approval should be limited to the situation described in the application.

VR3) ALLERGY & ASTHMA CARE PC – 101 INDUSTRIAL PARK ROAD - TAUNTON

The Petitioner (Mr. Wallace Fabian, project manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1 to eliminate the shower requirement. There are two restrooms. It is not stated whether these restrooms are handicap accessible. The Taunton Board of Health voted that it has no objections to this request.

VR4) DENTAL OFFICE – 207 SILVER STREET - GREENFIELD

The Petitioner (Mr. Lawrence Tuttle, Architect) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner is seeking a waiver from the shower requirement for this facility. The Greenfield Board of Health did not vote on this variance request as it is not the authority who grants the variance, however they do not object to the request and offer their support for whatever decision the State chooses with regard to the variance..

VR5) TILL INC – 20 EASTBROOK ROAD - DEDHAM

The Petitioner (Ms. Dafna Krouk Gordon, President) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner is requesting a waiver from the drinking fountain requirement. The facility uses a water filtration system that is built into the kitchen water supply. The Dedham Board of Health holds no opinion in the matter this applicant’s request.

VR6) ALLY’S EATERY 1-4 DOCK SQUARE - ROCKPORT

The Petitioner (Ms. Allison Callahan, Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (2) b. The petitioner is proposing to open a 250 square foot restaurant serving sandwiches. The petitioner notes there is only enough space for a small employee non-handicap restroom. The Rockport Board of Health does not oppose granting the variance..

VR7) AUBERTINE LOPES FUNERAL HOME – 129 ALLEN STREET – NEW BEDFORD

The Petitioner (Mr. Dan Sylvia, owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09 (1) (a). The garage door is proposed for access to the garage to allow the funeral hearse to come inside and out of public view as required by 239 CMR 3.06(g). The applicant proposes installing an 8-inch high concrete car stop that allows the vehicle just inside the garage, to allow the loading and unloading of the deceased from public view. . The New Bedford Board of Health considered the Plumbing Inspector’s recommendation; reviewed correspondence from the Fire Prevention Unit and the Building Commissioner which favored granting the waiver. The Board of Health voted unanimously to support the request.

 

VR8) TRITOWN RESIDENCES – 75, 95 PARKVIEW AVE. & 200 TROTTER ROAD - WEYMOUTH

The Petitioner (William Lane, Superior Plumbing, President) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform Plumbing Code Policy regarding combination space heating/potable water system which, clarified the  diagram previously posted on the website. The drawings were, designed and stamped prior to the posting of the new diagram on the website. The residential units are framed and ready for sheetrock. The South Shore Tri-Town Development Corporation acting as the Board of Health requested a hearing seeking relief from the distance allowed from the hat water heaters to the fan coil units..

VR9) GYRO & SANDWICH VILLAGE – 442 MAIN STREET - WOBURN

The Petitioner (Zorick Yesayan, Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner proposes one unisex handicap accessible restroom for patrons and 1 non-handicap restroom for employees. The petitioner notes there is not enough room to install two designated handicap restrooms. The Woburn Board of Health takes no position on this matter.

VR10) CONVENTION CENTER – 415 SUMMER STREET - BOSTON

The Petitioner (Don Rubino, Director of Facilities) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Plumbing Code, Section 3.04 (1). The petitioner seeks a waiver to allow the installation of two unlisted stainless steel trough drains in the kitchen. As this is a State project, no Board of Health letter is required.

VR11) CALI TANNING SALON – 1899 OCEAN STREET BUILDING P - MARSHFIELD

The Petitioner (Mr. Richard Eldridge, Eldridge Plumbing) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (i). The petitioner proposes installing a unisex handicap accessible restroom. The petitioner sites space limitations. The Woburn Board of Health takes no position on this matter.

VR12) KONARKA TECHNOLOGIES – 50 DUCHAINE BOULEVARD – NEW BEDFORD

The Petitioner (Mr. Paul Cardigan, Facility Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Fuel Gas Code, Section 3.04 (1). The petitioner is applying for this variance because the boiler the firm purchased is unlisted.  Special Permission Gas was granted for the piping only. The Board received the Engineer’s letter attesting the installation comples with 248 CMR. The Board also received the factory technician’s startup report. The report was reviewed by Board staff and Chairman Kennedy and found to be in order. As this is a gas variance, no Board of Health letter is required.

VR13) UMASS MEDICAL – 55 LAKE AVENUE NORTH - WORCESTER

The Petitioner (Mr. James Grasseschi, Grasseschi Plumbing) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Plumbing Code, Section 3.04 (1. The petitioner proposes installing a stainless steel sink that is not product accepted. The sink will be used for an endoscopy unit.

As this is a State project, no Board of Health letter is required.
