VARIANCE REQUESTS:

VR1) LA CAVE DU GRENIER RESTAURANT – 82 MAIN STREET – VINEYARD HAVEN

The Petitioner (Mr. Jean Dupon, Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner is proposing the installation of a new unisex handicap restroom in lieu of two designated handicap restrooms. The Tisbury Board of Health voted to support this variance request. The Board of Health notes this is the second request for consideration of this matter. The Health Board notes, Mr. Dupon originally agreed to install two handicap accessible restrooms. The property owner felt there was not adequate space to the two restrooms.

VR2a) MWRA-JOHN CARROLL WTP – 84 D'ANGELO DRIVE - MARLBOROUGH

The Petitioner (Mr. Jae Kim, Chief Engineer) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.06 to not require the installation of copper chemical carrier water piping downstream of the backflow preventer. The petitioner is requesting that CPVC piping be allowed. As this is a State Project a Board of Health letter is not required.

VR2b) MWRA-JOHN CARROLL WTP – 84 D'ANGELO DRIVE - MARLBOROUGH

The Petitioner (Mr. Jae Kim, Chief Engineer) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Fuel Gas Code, Section 10.02 (6). During a site visit State Inspector, Scott Padden noted that this facility required designated restrooms. The petitioner seeks relief from the requirement to install employee restrooms in this building. Designated restrooms are available in the chemical building located across the road. As this is a State Project, no Board of Health letter is required.

VR3a) BOOMERS PLAYLAND #38; LASER TAG – 160 NORTH MAIN STREET - CARVER

The Petitioner (Jeffery DeMoura, Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 Table 1. The petitioner seeks relief from the requirement to install designated restrooms. The petitioner is proposing the installation of a unisex handicap restroom. The Carver Board of Health and the Plumbing #38; Gas Department support this request.

VR3b) BOOMERS PLAYLAND #38; LASER TAG – 160 NORTH MAIN STREET - CARVER

The Petitioner (Jeffery DeMoura, Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 Table 1. The petitioner seeks relief from the requirement to install a drinking fountain. The petitioner is proposing the installation of a water cooler with disposable cups. The Carver Board of Health supports this request.

VR4) ENTERPRISE RENT A CARE – 28 LOCATIONS IN MASSACHUSETTS

The Petitioner (Mr. Mark Terry Sr., V.P. Plumbing Servicesr) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.15 (10). MWRA authorized the use of the Highland Tank manual oil interceptor at 28 locations in the state. The Board approval # is P3-1011-179. The petitioner notes that in some locations the outlet can be connected to a gravity drain within the building. In cases where connecting via gravity, the petitioner is requesting connecting to the building drain in compliance with 248 CMR section 10.15 (10).

VR5) NEW MARSHFIELD HIGH SCHOOL – 167 FOREST STREET – MARSHFIELD

The Petitioner (Mr.James Ziobro, Vice President-Griffith #38; Vary, Inc) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1.

The petitioner states the size of the existing site is too restricted to allow for a structure large enough to house the number of fixtures required by code. The petitioner is proposing a 50% reduction in the fixtures required in Table 1. The Marshfield Board of Health has no opinion on this matter and defers to the Plumbing Board.

VR6) ORGANOGENESIS, INC – 150 DAN ROAD – CANTON

The Petitioner (Mr.James Ziobro, Vice President-Griffith #38; Vary, Inc) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.06 (18) Materials.

All chemical neutralization lift stations assembled by Burt Process Equipment are, customized. These products do not fall into the standard category for Massachusetts Plumbing Product Approval. There are no product assemblies that are listed by the Plumbing Board that could replace this equipment. The Canton Board of Health endorses this request.
