VARIANCE REQUESTS:
VR1a) WINCHESTER HOSPITAL – 200 UNICORN PARK STREET - WOBURN
The Petitioner (Mr. Anthony Staffier) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner is seeking a waiver from the shower requirement. The Woburn Board of Health takes no position on the matter.

The petitioner is seeking a waiver from the drinking fountain requirement. The Woburn Board of Health takes no position on the matter.
VR 2) PORTUGALIA IMPORTS – 56 ELEVENTH STREET – FALL RIVER
The Petitioner (Mr. William Anctil, Master Plumber) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.06 (2) (o) The petitioner is seeking a waiver to allow the use of PVC piping in the washing and repackaging area. The Fall River Board of Health and the Plumbing Inspector, Francis Reilly support the request.
VR3) SUBWAY RESTAURANT – 502 EAST STREET - PITTSFIELD
The Petitioner (Mr. Christopher Dodge, Master Plumber) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (8) (d). The petitioner is seeking a waiver from the requirement to install a food waste grinder. The Pittsfield Board of Health supports this request.
As delegated by the Board, this request received Board Office approval to eliminate the shower requirement.
VR4) DENTIST OFFICE – 1842 BEACON STREET BROOKLINE
The Petitioner (Mr. Anthony Schuurman, Master Plumber) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner seeks a waiver to eliminate the requirement to install a shower is this medical facility The Brookline Board of Health supports this request.
VR5a) POLARIS SHEET METAL- 18 SARGENT STREET, UNIT 1 - GLOUCESTER
The Petitioner (Mr. Richard Murphy, Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner seeks a waiver from the requirement to install a urinal in the men’s restroom. The Gloucester Board of Health has no objection to this request.
VR5b) POLARIS SHEET METAL- 18 SARGENT STREET, UNIT 1 - GLOUCESTER
The Petitioner (Mr. Richard Murphy, Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner seeks a waiver from the requirement to install a shower. The Gloucester Board of Health has no objection to this request.
VR6) PEXCO, LLC – BURN-OFF OVEN - 764 SOUTH ATHOL ROAD - ATHOL
The Petitioner (Mr. Steve Grainger, P.E.) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00), the Uniform State Fuel Gas Code, Section 3.04 (1). UL conducted a conducted a field evaluation of the oven. UL report# 2012-196-FE is on file with the Board Office. As this is a Gas Variance, no Board of Health letter is required.
VR7) WYMAN GORDON – 244 WORCESTER STREET – NORTH GRAFTON
The Petitioner (Mr. John Sobanik, P.E.) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Fuel Gas Code, Section 3.04 (1). The petitioner is seeking a waiver from the requirement to use equipment from the Board’s accepted equipment list. As this is a Gas Variance, no Board of Health letter is required.
VR8) SPECIALTY MINERALS – 260 COLUMBIA STREET - ADAMS
The Petitioner (Mr. David Buttleman, Regional EHS Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Fuel Gas Code, Section 3.94 (1). The petitioner proposes to convert the oil fired Kiln to Natural Gas. John Cheslik, MRPE submitted a Field Certification Report which, is on file with this office. The Board Office along with Chairman Kennedy reviewed the report and found it to be acceptable. As this is a Gas Variance, no Board of Health letter is required.
The Petitioner will be out of town and requested the variance be rescheduled to September 5, 2012
VR9) TAUNTON BUSINESS IMPROVEMENT DISTRICT – 8 TRESCOTT STREET - TAUNTON
The Petitioner (Mr. Dean Harrison, Executive Director) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner seeks a waiver from the requirement to install drinking fountains. The petitioner proposes using Poland Springs dispensing systems. A Board of Health petition letter is on file with the Board office.
VR10) ST. MARY’S CREDIT UNION – 100 WEST MAIN STREET NORTHBOROUGH
The Petitioner (Mr. David W. Boyden, Facilities Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.15 (a) 2. The petitioner seeks a waiver to use a sewer ejector system for drainage that is not below the sewer level. Mr. Boyden provided a petition letter sent to the Northborough Board of Health. The Northborough inspector, Richard Desimone contacted Mr. Thomas to state he supports this request.
VR11) HAIR SALON (JENNIFER SOUTHARD) – 23 LEXINGTON AVENUE – GLOUCESTER
The Petitioner (Ms. Jennifer Southard, owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (i). The petitioner proposes installing one unisex handicap employee restroom in lieu of installing two non-handicap employee restrooms. The Gloucester Board of Health has no objection with this request.
VR12) DCR – GERARD MASON MEMORIAL POOL – 42 MAYNARD STREET – AGAWAM
The Petitioner (Mr. Michael Stiller, P.E.) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) Table 1. The petitioner seeks a waiver to not provide employee facilities in the unoccupied utility building. As this is a State Project no Board of Health petition letter is required.
VR13) KARL’S SAUSAGE KITCHEN – ONE BOURBON STREET – PEABODY
The Petitioner (Mr. Robert Gokey, owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Fuel Gas Code, Section 3.04 (1). Richard Bauer, MRPE submitted a Field certification report that is on file with this office. The Board Office, along with Chairman Kennedy, reviewed the report and found it to be acceptable. As this is a Gas Variance, no Board of Health letter is required.
VR14) CAPE ENTERPRISES – 1 GEORGE STREET, UNIT 1 - PLAINVILLE
The Petitioner (Mr. Gene Menard, owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09 (1) (b). Mr. Menard, in his statement, proposes the installation of bollards in front of the three overhead garage doors. The Plainville Board of Health defers to the Plumbing Board. As previously delegated by the Board, the Board Office reviewed the proposal and approved this request.
VR15) MWRA - NEFCO BIO-SOLIDS FACILITY – 97 EAST HOWARD STREET - QUINCY
The Petitioner (Mr. Ralph Manglass, P.E.) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Plumbing Code, Section 3.04 (1). Mr. Manglass is seeking a waiver to use products not listed on the Accepted Products Online System. As this is a Gas Variance, no Board of Health letter is required.
