VARIANCE REQUESTS:

VR1) ADVANCED EYE CARE - 1741 PRESIDENT AVE - FALL RIVER

The Petitioner (Jeffrey Shaker, Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10(18)(k) and Table 1 to not be required to install a 2 nd unisex handicap restroom on the 2 nd floor. The Fall River Board of Health defers the decision to the State Board.

VR2) MA COLLEGE OF LIBERAL ARTS - 375 CHURCH STREET - NORTH ADAMS

The Petitioner (Jeffrey Daignault, President) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.12(f) to allow pool backwash to discharge to the sanitary system in lieu of the storm system. As this is a state project, on Board of Health letter is required

VR3) EAST BOSTON NEIGHBORHOOD HEALTH CENTER - 20 MAVERICK SQAURE

The Petitioner (Kenneth Hong, Project Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10(18) Table 1 to not be required to provide drinking fountains or showers for this facility. The Boston Inspectional Services acting as the Board of Health renders no opinion.

VR4) CUMBERLAND FARMS - 1813 MAIN STREET - BROCKTON

This variance was previously heard on December 26, 2010. The Board denied this request. The Petitioner (Kathleen Souza, Land Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.00 to allow the installation of one unisex handicap accessible restroom for employees and the public, in lieu of the required two employee non-handicap restrooms. The Brockton Board of Health now supports this variance request.

VR5) CUMBERLAND FARMS - 323 MAIN STREET - HAVERHILL

Note: IAW Board vote on 3/31/10, Staff reviewed this variance and found acceptable.

The Petitioner (Ms. Kathleen Sousa, Land Planning Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10(18)(i)4 and Table 1, to allow the installation of one (1) unisex handicap accessible restroom in lieu of the required two non handicap accessible employee restrooms. The Adams Board of Health has no comment on the variance request.

VR6) BRIEN ADMINISTRATION BUILDING - 359 FENN STREET - PITTSFIELD

The Petitioner (James Benlien, Project Manager) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10(18) Table 1to not require the installation of drinking fountains. The petitioner proposes installing bottled water stations. The Pittsfield Board of Health supports the granting of this request.
