VARIANCE REQUESTS:

VR1) WESTERN MASS HOSPITAL - 91 EAST MOUNTAIN ROAD - WESTFIELD

The Petitioner (Mr. Derrick Tallman, CEO) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18) (k) 5 to waive the requirement to install drinking fountains in the hospital. The applicant proposes installing an alternative source of drinking water. As this is a State Facility no Board of Health is required.

VR2) PATWAYS FOR CHILDREN - 29 EMERSON AVENUE - GLOUCESTER

The Petitioner (Ms. Sue Todd, President & CEO) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Gas Code, Section 10.10 (18) (e) 2 to allow the installation of one unisex restroom in lieu of the required two. The Gloucester Board of Health does not object to this request, provided that the Head Start school age children do not use the classroom at the same time as stated in the application for a variance.

VR3) JAMEY POPE - 61 BEAVER POND ROAD - LINCOLN

The Petitioner (Mr. Jamey Pope, Owner) requests a variance from 248 CMR (Code of Massachusetts Regulation) 3.00, the Uniform State Plumbing Code, Section 3.04 (1) to allow the installation of a Diamond Spa that is presently not listed on the Board's Product Website. The Lincoln Board of Health does not object to the granting of this variance request.

VR4) M & S AUTO REPAIR - 919 MAIN STREET - WOBURN

The Petitioner (Mr. Mark Marcussion, President) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.10 (18)(i) to allow the installation of one unisex employee restroom in lieu of the required two. The Woburn Board of Health takes on position regarding this variance request.

VR5) QUINCY CATHOLIC ACADEMY - 370 HANCOCK STREET - QUINCY

The Petitioner (Mr. Paul Hines, Facilities Manger) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.15 (19) (a) 1., 2,

to allow the installation of a sewage ejector pump in the basement that will receive the discharge of two hand sinks, one urinal and two flush toilets installed in handicap accessible restrooms. The Quincy Board of Health is not opposed to the granting of this variance request.

VR6) MA MARITIME ACADEMY - 101 ACADEMY ROAD - BUZZARDS BAY

The Petitioner (Mr. Richard Barbera, Sr. Plumbing Engineer) requests a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.17 (2) to allow the roof conductor that exits the building discharge not be required to connect to a below grade storm system. The storm piping will spill to a drainage swale that runs to a retention pond that has an overflow to the Bay. As this is a state project no Board of Health letter is required.

VR7) The Petitioner (Mr. Paulo Albergaria, Owner) is requesting a variance from 248 CMR (Code of Massachusetts Regulation) 10.00, the Uniform State Plumbing Code, Section 10.09(1)(b) and 10.10(18)(i) to not require the installation of floor drains or a gas/oil/sand separator in the garage or employee restrooms. Mr. Albergaria has access to toilet facilities in his home that is across the street 125' from the garage. The Westport Board of Health supports to not be required to install floor drains or a g/o/s separator.

Now appears Mr. Michael Glass of M.D. Stetson Company to discuss the results of conferring with Mr. J. Octavio DePaula Santos, Environmental Analyst for the Department of Environmental Protection

EXAMINATION WAIVER

Now appears Edwin J. Rodriques seeking a Journemyan Plumber license based on this education, training, experience obtained in Puerto Rico. In addition Mr. Rodrigues holds status as an Official Plumber, license # 6094.

CLOSED SESSION
