Subject: Affordable Care Act (ACA) - Overview of Health Insurance Marketplaces
Comptroller Memo FY#2014-09
The Commonwealth of Massachusetts is required by law (§ 1512 of the ACA, which creates 29 U.S.C. 218b) to provide all employees the information contained in the attached notice.
This memo is being posted for reference and to document the various communications sent to departments in support of their issuing the ACA notice by October 1, 2013 to help all employees understand the health insurance Marketplaces option.
Employers are beginning to implement the new national health reform law, the Affordable Care Act (ACA) across the country. We, as the employers, are required to inform all current employees by October 1, 2013 of certain information relating to health insurance options through the Marketplaces.
Note: New employees after that date must receive the same notice.
To efficiently meet this requirement, we issued the attached “Overview of Health Insurance Marketplaces” to each agency, and requested that you circulate the notice individually to all of your employees, benefitted and non-benefitted, that receive their paycheck and W-2 from the Commonwealth’s payroll system, HR/CMS or HRDirect. Circulation to employees by email is acceptable, unless the employee does not have access to email at work. In that case, the Notice must be provided directly to employees.
A workgroup, represented by the Group Insurance Commission, Comptroller’s Office, Administration and Finance, Human Resources Division, Department of Higher Education, University of Massachusetts and the Health Connector, has been established to review and implement the requirements of ACA over the coming months. To date there has been ongoing work evaluating the data set up to accurately measure the full time or part-time status of our employees. The IRS recently released draft regulations on reporting requirements for comment. Please let me know if you are interested in sending a representative. We will keep you apprised of developments.
