RE: Chapter 268A Compliance Pledge

As you know, Section 41 of Chapter 176 of the Acts of 2011 amends Chapter 32 of the Massachusetts General Laws to require each retirement board member upon the commencement of his/her term to file with the retirement board and the Commission “…a statement acknowledging the member is aware of and will comply with the standards set forth in Chapter 268A, this chapter (Chapter 32) and rules and regulations promulgated under this chapter.”  Any retirement board member beginning a term after February 16, 2012 must complete this form and submit it to the retirement board and the Commission prior to assuming his/her position as a retirement board member and prior to commencing a new term after that date if the individual has served or is serving on a retirement board.  Current board members need not file such a form until re-election or re-appointment after February 16, 2012.

Please inform anyone seeking a position on your retirement board or who may be appointed to your retirement board that he/she is required to file the Form with the board and the Commission as part of the election/appointment process.
