The legislation filed by Governor Patrick last month, "An Act Mobilizing Economic Recovery in Massachusetts," is intended to provide additional tools to maximize the Commonwealth's receipt of federal funds available through the American Reinvestment and Recovery Act of 2009 (ARRA). The bill is currently pending in the Joint Committee Economic Development and Emerging Technologies. There has been some questions surrounding the impact of the bill's passage on procurements and bid awards. To clarify: The apprenticeship training requirements in the bill are not intended to not apply to projects that have been bid before the legislation is enacted. We do not recommend delaying projects until the legislature acts on this bill. In the meantime, all projects should continue to be bid under existing law. It should be noted, however, that certain other elements, including reporting requirements, will apply to all projects that receive ARRA funding.
