Purpose and scope

Pursuant to state policy, the Commonwealth establishes participation goals for minority business enterprises and women business enterprises on public construction projects.

This Administrative Bulletin fills a gap in current state policy with respect to setting minority business enterprise (MBE) and women business enterprise (WBE) goals on public building projects. Pursuant to legal requirements, the Division of Capital Asset Management (DCAM) establishes MBE/WBE participation goals which apply to design services and construction contract activity. However, these goals do not apply where DCAM does not maintain or exercise control of the public building project. This Administrative Bulletin creates a parallel system of MBE/WBE participation goals for these projects.

On February 17, 2011, the Governor signed Executive Order 527, which superseded Executive Order 519, "Establishing the Office of Access and Opportunity within the Executive Office for Administration and Finance." The Executive Order defines the scope of responsibilities and authority of the Office of Access and Opportunity (OAO), among which the OAO is to:

  • ensure non-discrimination, diversity and equal opportunity in all aspects of state employment, programs, services, activities, and decision-making, including but not limited to state contracting, including contracts for construction, design, and goods and services provided to state agencies;
  • review and recommend improvements to state agency programs, activities, and services to ensure that they foster access and equal opportunity; and
  • review and recommend improvements to state agency programs, activities, and services to foster economic opportunity for all persons.

Attached hereto is Guidance Relative to Minority Business Enterprise and Women Business Enterprise Participation on Public Building Projects delegated to or otherwise under the control of a State Agency other than the Division of Capital Asset Management.

A&F Secretary Approval and Effective Date

This Administrative Bulletin published by the Executive Office for Administration and Finance shall be effective as of the date specified below:
