Executive Order  No. 15: Suspension of banking operations during civil defense emergencies

WHEREAS, the protection of depositors in banks and the maintenance of the banking structure of the Commonwealth require that certain protective measures be taken in banks against the possible effects of an enemy attack; and

WHEREAS, these measures may cause suspension of banking operations during hours which would otherwise be business hours; and

WHEREAS, such suspension might otherwise subject a bank, in some circumstances, to civil liability therefor:

NOW, THEREFORE, I, Charles F. Jeff Sullivan, Lieutenant Governor, Acting Governor of the Commonwealth, acting under the provisions of Acts of 1950, chapter 639, as amended, and all other authority vested in me, do hereby issue this order to cope with the existing state of emergency and as a necessary preparatory step in advance of actual disaster.

1. In order to enable banks to remove funds, securities and records to places of safety and to enable bank personnel to take shelter, all banks within the Commonwealth are hereby authorized to suspend banking operations from the sounding of the red alert signal as defined in Executive Order No. 14, issued August 28, 1951, and until the expiration of such reasonable time as is required to resume banking operations after the sounding of the all clear signal as defined in said Executive Order No. 14.

2. Any such period of suspension of banking operations shall be deemed to be not included in the business hours of banks.

3. The provisions of this Order shall also apply to any practice alert conducted under the provisions of Section 7 or 8 of said Executive Order No. 14, provided however that no bank shall be civilly liable for suspension of banking operations during a practice alert because of the failure of any of the authorities specified in said Section 7 or 8 to comply fully with the requirements of said Sections.

GIVEN at the Executive Chamber in Boston this fifteenth day of February, in the year of our Lord one thousand nine hundred and fifty-two, and of the Independence of the United States of America, the one hundred and seventy-sixth.
