What you need

H-2A Agricultural Workers

The H-2A Temporary Labor Certification (Agricultural) Program allow employers to bring in non-immigrant agricultural workers to the U.S. for a time period of less than 365 days

Important Notice: Once approved by DCS; the employer must also send a copy of the ETA Form 790 submitted to the DCS with its Application for Temporary Employment Certification (ETA 9142A) to the Chicago National Processing Center (CNPC).

Who can participate?

A U.S. agricultural employer or an association of agricultural producers who has full‐time work that needs to be performed on a temporary or seasonal basis.

Where to file the application?

To file ETA-790 form; go to the H-2A “Application Login” icon.

Duration?

The need for the work must be seasonal or temporary in nature and tied to a certain time of the year by a recurring event or pattern, such as an annual growing cycle, normally lasting 10 months or less.

Impact on local employment?

The H-2A Program is designed to ensure that the admission of foreign nationals to work in the United States will not adversely affect the job opportunities, wages and working conditions of U.S. workers.

Timelines to file ETA-790?

The employer is required to submit the Agricultural and Food Processing Order (ETA -790 within 75 to 60 calendar days prior to the anticipated date of need.

Review of the ETA 790?

FLC staff may issue a ”Notice of Acceptance” or require the employer to submit additional documentation substantiating the appropriateness of any unusual qualification(s) or ask for clarification of any of the items contained in the ETA 790 and attachments.

How to file

Massachusetts H-2A Job Order Email Filing Procedures

Employer(s)/Agent(s) must file their original job offer with the Department of Career Services (DCS), Foreign Labor Certification Unit (FLC):

Two forms are required to be completed and submitted to DCS.
   
Note: If you are not represented by an agent/representative, you will complete only the Job Order Form below.

     A. ETA 790 Form (link)

1) Download the ETA 790 form and save it to your computer.
2) Fill out all items on the form. (Please ensure all fields have been filled in.)
3) Electronically sign (e-sign) and date the form, and save.
4) E-mail the ETA 790 and attachments to DCS at H2APrograms@MassMail.State.MA.US

    B. Employer/Agent (representative) Agreement:

1) Download the Form
2) Fill out all items on the form. (Please ensure all fields have been filled in.)
3) Sign, date and print the form, then e-mail it to DCS at H2APrograms@MassMail.State.MA.US.
