What you need for Report disability-based discrimination

You can file complaints alleging a violation of:

  • State or federal laws
  • Regulations protecting individuals from discrimination based on disability

File a complaint if you have faced discrimination in any programs, activities or services. To file an informal complaint with the State House ADA Coordinator, you will need:

  • Your name
  • Your address
  • A brief description of the alleged action prohibited by the laws and regulations
  • The date this action allegedly occurred

Make sure to file your complaint within 30 days of the alleged discrimination. If you need help preparing or filing your complaint, please reach out to the State House ADA Coordinator.

Next steps for Report disability-based discrimination

Written decision

The State House ADA Coordinator's Office will investigate your complaint. We will send you a written decision no more than 30 days from when we receive your complaint. If we deem your complaint valid, we will issue a corrective action plan.

We will maintain the files and records from your complaint. If you aren't satisfied with our decision or corrective action plan, please notify the State House ADA Coordinator. We will forward your complaint to the Secretariat ADA Coordinator for further review.

The Secretariat ADA Coordinator will review our findings, decision, and action plan. They will discuss your grievance with the Massachusetts Office on Disability (MOD). The Secretariat ADA Coordinator may then investigate your complaint further. They will send you their written decision affirming, reversing, or changing our original decision or action plan.

Any decision denying your complaint by the Secretariat ADA Coordinator will be reviewed by MOD. Negative decisions will not become final until 10 days after MOD receives them.

We will review your complaint no matter if you file complaints with:

  • Massachusetts Office on Disability (MOD)
  • Massachusetts Commission Against Discrimination (MCAD)
  • Appropriate federal Office for Civil Rights
  • Any other state or federal entity
  • Any state or federal court

MOD can only review complaints about:

  • Public accommodations
  • State government programs, activities, and services

If you are an applicant or employee of an Executive Branch entity, the Office of Diversity and Equal Opportunity will address your employment-related complaints. This grievance process is a quick, informal one. This is not a substitute for the more formal MCAD, ORC, or Court processes.
