What you need

If you receive a marijuana possession ticket, you have 21 days to pay it. Otherwise, you need to request a hearing within 21 days. The penalties for marijuana possession include:

  • $100 fine
  • Forfeiting the marijuana 
  • Completing a drug awareness program if you're under 18
  • Potential additional fines for violating city or town bylaws that prohibit smoking marijuana in public 

How to respond

Return the ticket with payment to the city or town clerk within 21 days, or to the clerk-magistrate of the District Court or Boston Municipal Court with your request for a civil hearing. The hearing may be held by a clerk or judge.

If you're under 18 and don’t complete the drug awareness program and its required community service, the fine may be increased to $1,000. You and your parents are equally liable to pay that amount. If you're under 17 at the time of the offense, failing to complete the program may be a basis for delinquency proceedings .
