The Superior Court Rules Committee is soliciting comments on a proposed amendment to Rule 47, Filing of Papers upon Judgment. The amendment addresses the circumstance when a person seeks to enforce a lost or stolen negotiable instrument. It requires the claimant to provide proof in writing that the person required to pay the instrument is adequately protected against loss that might occur by reason of a claim by another person to enforce the instrument, under G. L. c. 106, § 3–309(b).

Comments should be sent to alex.philipson@jud.state.ma.us, or to Alex G. Philipson, Administrative Attorney, Massachusetts Superior Court, Three Pemberton Square, 13th Floor, Boston, MA 02108.

The deadline for submitting comments is February 15, 2018.
