The Probate and Family Court is pleased to announce that effective immediately, Standing Order 3-17, Fiduciary Litigation Session Pilot Project shall apply to cases filed in both the Essex and the Plymouth divisions of the Probate and Family Court.
In November 2017, Standing Order 3-17 established a Fiduciary Litigation Session (“FLS”) to be held in the Norfolk division of the Probate and Family Court for a pilot period of one year. The Honorable Elaine M. Moriarty (ret.) is the presiding judge. The goal of the FLS is to provide a specialized forum for the speedy resolution of contested and complex probate litigation cases and to provide individualized and collaborative case management to reduce the costs associated with fiduciary litigation. Initially, Standing Order 3-17 applied only to cases filed in the Middlesex, Norfolk and Suffolk divisions.
