Re: Unlicensed School Closure


 

On June 26, 2003 the Department of Elementary and Secondary Education sent a letter to CertiViable, Inc. at the above address in response to information received by the Department of Employment and Training that this school may need to be licensed in accordance with M.G.L. c. 75D. The school did not respond and the Department sent a second notice on October 29, 2003 requesting them to contact the Department regarding the possible need to be licensed. Brian Gens, the owner of record, has not contacted the Department nor has he responded to the Department's attempts to reach him.

On November 3, 2003, the Department received complaint from a CertiViable student that the school had closed its doors. Further investigation by the Department revealed that the school is not open and the affiliate listed on their web-site, Linux Centers USA, is also not operating.

Since the school was operating without a license from the Department of Elementary and Secondary Education, unfortunately there is no bond against which students may file a claim for restitution of unearned tuition. Therefore, students should NOT file a complaint or a claim for restitution with the Department. Instead, students should contact the Office of Consumer Affairs within the Attorney General's Office to file a consumer complaint.

If the Department receives any updated information, we will keep students informed by posting bulletins on this web-site. The Department greatly appreciates your help in keeping the volume of phone calls it receives to a minimum by checking these bulletins as it helps our small staff concentrate on completing the high volume of work experienced by this unit.
