RE: Claims for Restitution

Hendriks Institute of Massachusetts, located in Woburn, closed on April 1, 2003. The owner did not comply with the regulations for private occupational schools and provide the Department with a list of current students; however, the New York franchisor provided a list of students whom they believed to be attending at the time of the closure.

A memo and a Claim for Restitution form were sent to all listed Hendriks students on May 30, 2003 (see attached). Claims were due to the Department on June 20, 2003. If you did not receive a Claim for Restitution form, please download a claim form, complete it, attached the required documentation and send it immediately to the Department. Once the Department submits the claims to the insurance company, additional claims cannot be accepted. Students who have obtained a discharge of student loans, a reversal of credit card payments, or who were able to stop payments on checks do not need to file a claim for restitution.

The Department is reviewing all claims and is in the process of contacting claimants who are missing documentation. This process may take several months. Once this portion of the process is complete, the Department will work with the insurance company to obtain payment from the insurance bond to provide restitution to claimants. The percent of individual restitution will be determined by the amount of the claims against the bond.

The Department will post additional information as it becomes available.

The Department greatly appreciates your help in keeping the volume of phone calls it receives to a minimum by checking this web-site for future updates as it helps our small staff concentrate on completing the high volume of work experienced by this unit. We thank you for your help and patience in this matter.
