How the public input process for HCBS waiver renewal applications works

Home- and Community- Based Services (HCBS) waivers are typically approved for a five year period and then must be renewed with the Centers for Medicare and Medicaid Services (CMS). This webpage contains information about waivers MassHealth is currently renewing with CMS. Please see below for links to the waiver renewal applications and information about how to provide feedback on the renewals to MassHealth.

 

DDS Waiver Renewal Applications—Drafts

The Executive Office of Health and Human Services (EOHHS) is working with the Department of Developmental Services (DDS) to renew three MassHealth Home- and Community-Based Services (HCBS) waivers for individuals with Intellectual Disabilities.

(1) Intensive Supports Waiver (DDS-IS)

(2) Community Living Waiver (DDS-CL)

(3) Adult Supports Waiver (DDS-AS)

As part of the waiver renewal process, EOHHS plans continued growth of waiver capacity, as well as certain updates to the waivers as summarized below:

  • Add waiver capacity
  • Remove unused or underused services from the waivers: Center-based Day Supports (sheltered workshops); physical, occupational, and speech therapy; and 24-hour Self-Directed Home Sharing Support (DDS-IS only)
  • Increase the limit on Individual Goods and Services to $3,000/year
  • Set a limit of 90 days/year for Stabilization
  • Require federal background checks for provider agency employees
  • Allow state-operated providers to deliver certain waiver services
  • Technical corrections and clarifications

The first forum will be held on Tuesday, February 13, 2018, at 11:00 A.M. at the Framingham Public Library Costin Room: Main Library, 49 Lexington Street, Framingham, MA.

The second public forum will be held on Thursday, February 15, 2018, at 12:00 P.M. at the Springfield City Library Community Room: Central Library, 220 State Street, Springfield, MA.

  • Inclement weather policy: If the local public schools are closed on the day of either forum due to weather conditions, EOHHS will cancel that forum and will hold a make-up forum.

In the event of cancellation on February 13, a makeup forum would be held on Thursday, February 22, 2018, at 11:00 A.M. at the Framingham Public Library Costin Room: Main Library, 49 Lexington Street, Framingham, MA. In the event of cancellation on February 15, a makeup forum would be held on Tuesday, February 20, 2018, at 11:00 A.M. at the Springfield City Library Community Room: Central Library, 220 State Street, Springfield, MA.

MFP and ABI Waivers

MassHealth is working with the Department of Developmental Services (DDS) and the Massachusetts Rehabilitation Commission (MRC) to renew four home- and community-based services (HCBS) waivers:

  1. Acquired Brain Injury (ABI) Residential Habilitation Waiver
  2. ABI Non-Residential Habilitation Waiver
  3. Money Follows the Person (MFP) Community Living Waiver
  4. MFP Residential Supports Waiver

As part of the waiver renewal process, MassHealth plans to ask the Centers for Medicare & Medicaid Services (CMS) to approve:

  • continued growth of waiver capacity
  • certain updates to the MFP and ABI waivers

We summarize these changes below.

MFP Waivers

For the MFP waivers, here's what we've done:

Changed the name of the waivers to the

  • Moving Forward Plan Community Living (MFP-CL) Waiver

  • Moving Forward Plan Residential Supports (MFP-RS) Waiver

Replaced 4 managed behavioral health waiver services with a new behavioral health waiver service:  community behavioral health support and navigation (CBHSN).

Added community-based day supports (CBDS) as a new waiver service.

Added a new service limit that:

  • Precludes the provision of day services on the same day as CBDS, supported employment, or pre-vocational services, and
  • Establishes an overall aggregate service limit of 156 hours per month for these services

Made technical corrections and clarifications.

ABI Waivers

For the ABI waivers, here's what we've done:

Allowed submission of applications for the ABI waivers before a person’s 90th day in a facility.

Added CBDS as a new waiver service.

Added a new service limit that:

  • Prevents providing day services on the same day as CBDS or supported employment, and
  • Establishes an overall total service limit of 156 hours per month for these services

Made technical corrections and clarifications
