VL 700.00 Voluntary Separation Package

0026 2258 07 (Apr. 24, 2019) – The claimant failed to show that her decision to accept a voluntary separation package and leave her employment was based upon a reasonable fear of imminent layoff.  This is without regard to whether the employer hired additional personnel after the claimant separated, because this is immaterial to the claimant’s knowledge and the reasonableness of her belief at the time she made the decision to resign.

0018 6461 03 (Jan. 31, 2017) – Under State Street, the claimant was eligible for benefits under G.L. c. 151A, § 25(e)(1), when he accepted a VSP and resigned.  Circumstances indicated that his job function was being moved to Ireland, he was not included with a new IT restructuring, and the employer did not make any information available to the claimant from which he could assess the likelihood that his own position would be eliminated.

0013 8682 91 (June 1, 2016) – Claimant, who resigned with a voluntary retirement package, did not have a reasonable belief of imminent layoff.  Empty offices, fewer manufacturing orders, a news article about the company reducing its worldwide workforce by 10%, and training someone to perform her job during an earlier medical leave, could give rise to a concern, but the claimant never asked whether her job was in jeopardy.

0015 4276 73 (May 10, 2016) – The claimant failed to establish that she had a reasonable belief that she would soon be involuntarily terminated or transferred to an unsuitable position, if she did not accept the employer’s voluntary separation package, where nothing in the record suggested that the employer hindered her ability to assess her job security, and the claimant made no effort to ask her employer or union about it.
