Two years after the implementation of Article V of the Massachusetts Uniform Probate Code, the Probate and Family Court is pleased to announce the release of new and revised forms for Guardianship and Conservatorship matters.   All forms must be filed with the Court by mail or in person. All new and revised forms have an effective date of June 30, 2011.

 

Since the 1983 decision of Rogers v Commissioner of the Department of Mental Health, 390 Mass 489 (1983), the Probate and Family Court has been charged with acting upon requests for permission to administer antipsychotic medications to individuals who are unable to consent themselves. A substituted judgment standard applies and, at a minimum, yearly reviews are required. The Probate and Family Court is pleased to announce the release of new and revised forms to be used for administrative processing of uncontested Rogers matters. The forms created for these annual reviews have an effective date of July 1, 2011.

 

The forms are available in two formats: one version may be printed and completed by hand and the other version may be completed on-line and saved.
