2007 Amendments to the MCP
These amendments and technical corrections were published in the Massachusetts Register on December 14, 2007. The new provision at 310 CMR 40.0570 (Requirements for Eligible Persons, Eligible Tenants or Other Persons Seeking to Re-Establish Response Action Deadlines) went into effect on December 14, 2007. The remaining provisions are effective on February 14, 2008.

The Massachusetts Oil and Hazardous Materials List
The Massachusetts Oil and Hazardous Materials List ("MOHML"), 310 CMR 40.1600
December 14, 2007 (effective February 14, 2008)
The Reportable Quantities (RQs) and Reportable Concentrations (RCs) for hundreds of chemicals. The RQs and RCs are used in combination with the notification requirements specified in Subpart C of the Massachusetts Contingency Plan to determine whether a release to the environment must be reported to MassDEP.

2007 MOHML Revisions & Corrections
Effective 2/14/08
Changes in Reportable Concentrations - The MCP at 310 CMR 40.0360(1) specifies that notification obligations for soil and groundwater data are tied to the Reportable Concentration(s) "in effect on the date of the sample analysis." Given that the MCP amendments that become effective on February 14, 2008 will result in changes to a number of Reportable Concentrations (RCs), parties are advised of the following:
- With respect to contaminants for which the RC will be LOWERED (i.e., set at a lower concentration), parties are only obligated to report if they equal or exceed an RC in effect on the date of the sample analysis.
- With respect to contaminants for which the RC will be RAISED (i.e., set at a higher concentration), MassDEP will exercise enforcement discretion against those parties who do not notify because they are applying the new (February 14, 2008) RCs. This only applies to samples that were analyzed on or after October 17, 2007 (i.e., 120 days prior to February 14, 2008).
