You must certify your compliance with all applicable MassDEP requirements within 18 months of your most recent third-party inspection report submission.

  1. What to Know

    The Department of Environmental Protection (MassDEP) requires you, as the owner/operator of an Underground Storage Tank (UST) system, to submit a Compliance Certification every three years, midway between third-party inspections, to document that you are properly operating and maintaining your UST system. This requirement, found at 310 CMR 80.34, took effect on November 1, 2015. 

    Important Note: The requirement that you obtain or renew a Certificate of Compliance (COC) allowing for your facility's participation in the UST Petroleum Product Cleanup (21J) Fund is a separate requirement administered by the Massachusetts Department of Revenue. 

  2. Login to the UST Data Management System

    If you are a new user, you will need to create an account and submit a completed and notarized Standard Proof of Identity Form, available below. You may fill out and save the Microsoft Word form on your computer. The PDF version has to be printed out and completed by hand.

  3. Review Your Facility Registration Online

    The UST Data Management System uses the information on file about your facility to generate a Compliance Certification "smart form" that is customized to your UST system(s). If you need to make any corrections or updates to your facility registration, please do so before you begin work on your Compliance Certification.

  4. Review the Guidance & Instructions

    • Help in identifying the compliance requirements for your specific UST system configuration, as well as gather and compile all the documentation you will need, to accurately answer all questions.

  5. Complete Your Submission to MassDEP

    Submit your Compliance Certification via the UST Data Management System.

    The system will generate a Return to Compliance (RTC) Plan if you identify any deficiencies or violations in your Compliance Certification. You will then have 30 days to make corrections and submit your RTC Plan.
