Appeal a Decision of the AAB

If you disagree with a decision made by the Board, you may be able to request the Board reconsider or appeal to Superior Court. Information on the methods of appealing the Board's decisions can be found below.

Requesting an Adjudicatory Hearing

If you are seeking to appeal a decision made at an administrative review which you received notice for in the past 30 days, then you can appeal to a full hearing of the AAB by filling out the Adjudicatory Hearing Request form below and sending it to the Board's staff via mail or email.  It is important to keep in  mind that the Board's Staff must receive your request within 30 days of your receipt of the original decision.

Once the Board's staff has received your request a hearing with be scheduled in the next available hearing slot, and Notice of Hearing will be sent to all parties providing the specific date and time of the hearing.

Motion for Reconsideration

If you wish to appeal a final decision of the AAB, you may make a Motion for Reconsideration as laid out in 521 CMR 4.4.2.  Please bear in mind the Board's staff must have received your motion within 10 days of your receipt of the Board's decision.  Your motion must be based on facts or evidence which was "not reasonably available at the time of the hearing."

Appeal to Superior Court

If the time period for a Request for Adjudicatory Hearing or Motion for Reconsideration has elapsed or you otherwise wish to appeal the AAB's decision, you may appeal to State Superior Court in accordance with the provisions of M.G.L. c. 30A, § 14.
