Purpose and Scope

Consistent with the requirements of Title I of the Americans with Disabilities Act  (“ADA”) 42 U.S.C. §§ 12101-12117, 12201-12213 as amended and Executive Order 526, and to assist executive branch agencies in their efforts to meet the obligations of both, this Administrative Bulletin establishes the Reasonable Accommodations Capital Reserve Account (“RACRA”).  The RACRA is a pool of funds that exist to facilitate the ability of executive branch agencies to provide reasonable accommodations to executive branch employees when and where the agency requires financial assistance to do so.

Title I of the Americans with Disabilities Act requires an employer to provide reasonable accommodation to qualified individuals with disabilities who are employees or applicants for employment, unless to do so would cause undue hardship.  Executive Order 526 establishes a policy of non-discrimination and equal opportunity in the delivery of state programs, services and activities.  The primary responsibility for the provision of a reasonable accommodation rests with each administrative agency within the executive branch.  However, in recognition that there are instances in which such administrative agency may require financial assistance in order to provide the reasonable accommodation, the Executive Office for Administration and Finance has created the Reasonable Accommodations Capital Reserve Account or RACRA to serve as a supplemental resource, available pursuant to the guidelines herein.
