Commonwealth v. Grafton
Appeals Court, August 14, 2018
(Crimes/Fire Protection)
The defendant’s failure to obtain a permit to remove a fire protection device is not an element of G. L. c. 148, § 27A , the disconnecting and removing fire protection devices, which the Commonwealth must prove at trial, but rather, an affirmative defense that the defendant must raise.
