An individual cannot be charged with operating a motor vehicle after suspension for operating while under the influence, G.L. c. 90, § 23, third par., based on an administrative license suspension pursuant to G.L. c. 90, § 24 (1) (f) (2), for the failure or refusal of a breath test.
