 There are sufficient facts to prove that a defendant operated his vehicle negligently pursuant to  G. L. c. 90, § 24 (2) (a),  when a defendant drives below the posted speed limit while holding a cell phone close to his face, and shows some signs of intoxication when stopped by a trooper.
