Date: 07/02/2019
Organization: Massachusetts Supreme Judicial Court

Commonwealth v. Wassilie
Supreme Judicial Court, July 2, 2019
(Electronic Surveillance/Unit of Prosecution)

The defendant was convicted on ten indictments of secretly videotaping with his cell phone unsuspecting individual adult victims who were nude or partially nude in a public bathroom in violation of G. L. 272, §105 (b), first paragraph.  The Court held that the proper unit of prosecution is based on the number of victims rather than the episode of videotaping (collection as a whole).
