Decision  Commonwealth v. Wilbur W., a juvenile

Date: 04/25/2018
Organization: Massachusetts Supreme Judicial Court

Commonwealth v. Wilbur W., a juvenile
Supreme Judicial Court, April 25, 2018
(Crimes/Statutory Rape)

A conviction of statutory rape is constitutional as it applies to a juvenile offender under the age of sixteen, where the juvenile claims that he was involved in consensual sexual encounter with another child however, the evidence shows otherwise.

 Note:

The Court declined to answer the question regarding consenting juveniles - “[t]he issues the juvenile raises as to experimentation among consenting juveniles are not before us in this case, where the victim testified that he was afraid and felt compelled to comply with the juvenile's demands.”
