Instructions
- MSAC’s governing statutes may be found at General Laws Chapter 147, Section 32-51; Please note that the MSAC is unable to vary anything that is statutorily required or authorized.
- You must cite each specific provision of 523 CMR from which you are seeking to vary, and foreach, provide detail regarding what you propose to do instead. Attach a separate sheet(s) of paper, using the same format as in the form, if you need additional space.
- You must submit this form at least 30 days prior to the proposed event date, and 7 days prior to the MSAC meeting at which you would like it to be reviewed.
- You must email your completed form, or any questions you need answered before you can complete the form, to MSAC@mass.gov.
Example
- When and where do you want to hold your event for which the variance is requested?
A: We will be holding an event on December 5 in Springfield at the ABC Building. - Have you requested this variance before? When? Was it was granted or denied?
A: We previously made the same request on October 10, 2023 and the Commission granted the requested variance. - Provide any other details you want the MSAC to consider related to your variance request.
A: Muay Thai combatants usually fight in a ring, but the specific contestants for this event prefer the use of a cage or “fenced area,” which is the typical enclosure for mixed martial arts, and is no less safe than a ring in this circumstance. - Identify the specific provision or provisions of 523 CMR from which you are seeking to vary:
- Regulation Cite(s) and Requirement(s): 523 CMR 23.02 states: Southeast Asian Kickboxing competitions must be conducted in a ring in conformance with 523 CMR 23.02(2).
- Proposed Variance: Permit used of cage compliant with 523 CMR 12.09.
