The Supreme Judicial Court Rules Committee invites comment on a proposed amendment to SJC Rule 3:01, Section 1.2.6.
Currently, Section 1.2.6 allows petitioners to seek admission in Massachusetts by transfer of a Uniform Bar Examination (UBE) score if they achieved a passing score not more than 36 months prior to filing for admission. Section 6.1.1 of the rule allows petitioners to seek admission by motion if they have been admitted to the bar in another state, district, or territory of the United States for at least five years prior to filing their petition for admission. This leaves a period from 37 months until 60 months after passing the UBE during which a petitioner cannot seek admission by either transfer of UBE score or motion. The proposed amendment would eliminate that gap and allow transfer of a UBE score for 5 years, after which a petitioner could seek admission by motion.
