Notice Inviting Comment on Proposed Amendments to Rule 12 of the Massachusetts Rules of Criminal Procedure

Comments may be submitted on or before April 17, 2024.

As explained more fully in the draft Reporter’s Notes, the proposed amendments of Rules 12(c) and (d) implement the disclosure requirements from Commonwealth v. DiBenedetto, 491 Mass. 390, 405-407 (2023), when parties enter plea agreements with multiple defendants, in which the offer to one defendant is conditioned on one or more codefendants also pleading guilty (so-called “package deal” plea agreements).
