Notice Inviting Comment on Proposed Amendments to the Massachusetts Rules of Professional Conduct (SJC Rule 3:07)

The Supreme Judicial Court Standing Advisory Committee on the Rules of Professional Conduct ("Standing Committee") invites public comments on proposed amendments to Rule 1.16 of the Massachusetts Rules of Professional Conduct and Comments 1 and 2 to that Rule.

The following documents are available for review at the links below:

  • A summary of the proposed amendments and discussion of the background for the Standing Committee’s proposals; and
  • A copy of the proposed amendments, together with copies of the proposed amendments marked to show the changes from (i) current Massachusetts Rule 1.16 and related comments, and (ii) current American Bar Association Model Rule 1.16 and related comments.

The Committee will make its recommendations to the Justices of the Supreme Judicial Court following review of all public comments received on the proposed amendments. Comments are due by June 21, 2024, and should be directed to the SJC Standing Advisory Committee on the Rules of Professional Conduct, c/o Chip Phinney, Deputy Legal Counsel, Supreme Judicial Court, John Adams Courthouse, One Pemberton Square, Boston MA 02108. Comments may also be sent by email to chip.phinney@jud.state.ma.us. Comments received will be made available to the public.
