Notice Inviting Comment on Proposed Amendments to the Model Jury Instructions on Eyewitness Identification

Comments are due on or before September 16, 2025.

The Supreme Judicial Court’s Standing Committee on Eyewitness Identification solicits comments on proposed revisions to the Model Jury Instructions on Eyewitness Identification, 473 Mass. 1051 (2015). The proposed revisions are extensive, due in large part to the Committee’s effort to make the instructions clearer by replacing existing text with plain language. The extent of the proposed revisions makes a blackline impracticable. Instead, the Committee’s chairperson, the Hon. Douglas H. Wilkins (ret.), has prepared an overview of the proposed revisions to facilitate review.

Comments should be directed to Timothy E. Maguire, Supreme Judicial Court, John Adams Courthouse, One Pemberton Square, Boston, MA 02108 on or before September 16, 2025. Comments may also be emailed to timothy.maguire@jud.state.ma.us. Comments received will be made available to the public.
