MassDEP has prepared revisions to the Massachusetts Contingency Plan ("MCP", 310 CMR 40.0000), which are the regulations governing the notification, assessment, cleanup and closure of oil and hazardous material disposal sites.
The revisions address numerous aspects of the cleanup regulations, including new standards for per- and polyfluoroalkyl substances (PFAS).
The Department solicited both written and oral public comment on these proposals. Four public hearings were held between May 20 - 29, 2019. The public comment period ended July 19, 2019.
The Department is currently reviewing and revising the proposed regulations before promulgating them as final.
Note that, In the interest of coordinating the implementation of the PFAS-related MCP provisions with the regulatory process to establish PFAS Maximum Contaminant Levels for public water supplies under the Massachusetts Drinking Water Regulations, 310 CMR 22.00, MassDEP is moving forward with finalizing the PFAS-related MCP provisions at this time; the balance of the proposed MCP amendments will be addressed in a subsequent final amendments package.
