Regulation 310 CMR 19.000: Solid Waste Facility Regulations

Through these regulations, MassDEP aims to prevent pollution, maximize materials reuse, and conserve both natural resources and energy by ensuring the proper handling, transfer, processing and disposal of solid waste.

Proposed Amendments & Public Comment

March 2022

  • 310 CMR 19.061: Solid Waste Management Emergency Amendments
    Effective March 30, 2022, these amendments enable MassDEP to respond immediately to an outbreak of infectious disease in animals (such as avian influenza). They specifically allow MassDEP, in coordination with the Massachusetts Department of Agricultural Resources, the Division of Fish & Wildlife, and the Department of Public Health, to approve a combustion facility or an ash landfill to accept infectious bird or animal carcasses, including associated waste materials, without the facility needing to go through the presumptive approval process otherwise required by the regulation.
