Important Notices to TPM - COVID-19 Pandemic

Due to the COVID-19 pandemic, please note the following.
  • Escrow Payments. Massachusetts will not extend any deadlines regarding escrow deposits.   
  • Annual Certification. If a TPM contends there is good cause to extend a deadline to submit certification materials, the TPM shall prepare a written request for an extension of time:
    • The request for an extension of time shall be in writing.  Because our staff may be working remotely and to ensure that requests are timely received, email your requests for an extension of time to both daniel.less@mass.gov and msa@mass.gov.
    • Requests for extension of time shall: (1) be submitted at least two weeks before the April 30, 2020 filing deadline; (2) provide good cause for the proposed extension; (3) explain the amount of work that still needs to be completed; and (4) propose a new deadline.
    • Our office will determine whether an extension of time is appropriate and, if good cause exists, the duration of the extension provided to the TPM.     
    • Massachusetts’s willingness to consider or grant extensions of time during the unprecedented conditions posed by COVID-19 does not waive or otherwise alter Massachusetts’s right to refuse to consider or grant any extensions of time in the future.
  • Digital Submission. TPM’s are strongly encouraged to submit their certification materials (completed forms, attachments, packaging samples, etc.) digitally by (a) emailing all materials to both daniel.less@mass.gov and msa@mass.gov; (b) if the materials are too large to email, placing them in a “sharedrive” type system and emailing a link to the sharedrive to both daniel.less@mass.gov and msa@mass.gov from which our office can download the materials; or (c) if the TPM does not have a sharedrive system, send an email to both daniel.less@mass.gov and msa@mass.gov for further instructions.
