Overview
Notice of Hearing regarding the job classification for the following tasks: patching block walls; rubbing block walls; cutting joints; rubbing and cleaning bricks; and installing wall ties
The Massachusetts Department of Labor Standards (DLS) will conduct a hearing at 10 a.m. on December 10, 2024 concerning the appropriate job classifications for the following tasks: (1) patching block walls; (2) rubbing block walls; (3) cutting joints; (4) rubbing and cleaning bricks; and (5) installing wall ties. This hearing will be conducted online via Webex and can be accessed at the following link: https://eolwdma.webex.com/eolwdma/j.php?MTID=ma299752f2da68502e9986b6a60a04b3b
DLS previously held a hearing on these topics on January 27, 2021, and issued an opinion letter on December 17, 2021 (available here). It has come to DLS’ attention that there may be new evidence regarding these job classifications that was not available at the January 27, 2021 hearing. The focus of the December 10, 2024 hearing will therefore be whether this purported new evidence is sufficient to necessitate DLS changing any of its current job classifications for the tasks above.
Interested parties and/or duly authorized agents thereof may attend the hearing and submit testimony regarding whether this new evidence changes the appropriate job classifications for the five tasks listed above. Written evidence may also be submitted by email either prior to the hearing or by December 13, 2024, at 5pm. Persons who want to submit evidence or otherwise have questions or need further information should contact General Counsel Nick Rose at nicholas.w.rose@mass.gov or call (617) 626-6837.
